IRS Seizes First, Asks Questions Later

When Carole Hinders answered a knock at the front door of her home in August 2013, she was confronted by two IRS agents. They told her they had just cleaned out the entire bank account of the restaurant, Mrs. Lady’s Mexican Food, that Hinders had owned and operated in tiny Spirit Lake, Iowa, for the past 30 years. The IRS seized more than $32,000.

The aggressive tactics adopted by law enforcement in structuring cases are, perhaps, unsurprising given that the proceeds of forfeited property are funneled back to the very agencies responsible for the forfeiture — an arrangement that gives law enforcement a perverse financial incentive to seize as much as possible.

Under federal law, funds seized by the IRS are deposited in the Treasury Forfeiture Fund. Those funds are then available, without any appropriation by Congress, for use by the IRS to fund law enforcement activities including seizures of additional property. The result is a vicious cycle, in which abuse of innocent Americans like Hinders makes it possible for government to seize even more property.

Congress is just now waking up to the abuse of civil forfeiture laws. Last month, Sen. Rand Paul (R-Ky.) and Rep. Tim Walberg (R-Mich.) introduced the Fifth Amendment Integrity Restoration Act, which would make it harder for the government to take property from people who have never been charged with, let alone convicted of, any crime, and easier for innocent owners to get the property back when it is wrongfully seized.

Fedgov not only routinely punishes its own citizens; it now shows its contempt for the citizens by rewarding illegal aliens with IRS tax credits for taxes not paid.

Yup. At this point in history a party supposedly opposed to abusive federal taxation would have repealed the enabling legislation, closed the clearly criminally politicised collection agency, and figured out a more sensible approach.

But not them. And Loretta “Gimme Yo Money” Lynch is still going to get voted in by these phonies.

When we moved to KY, my wife got some sort of tax exempt card because we thought we might be doing some buying and selling of antiques. Nothing came of it so we just forgot about it.

Then in February of the next year our house payment bounced because they had stripped our KY bank account. Fortunately they could not touch our main account in Seattle.

Turns out that we were supposed to file a statement on usage of the card and since we didn’t, they just imputed something like $1,800 in probable taxes owed by us. The funny thing is that after a lot of back and forth mail and phone converstions it still ended up costing us $400 in the end.

This experience and our FedGov’s hostility to small business is why I will never start a “legitimate” business. I refuse to go to bed with the government. They are your primary antagonist, even more than landlords and competition.

I see them quite LITERALLY as the mob to which you pay as much “protection money” as they think they can get away with charging.

In several very real ways, I’ve gone Galt. And they increase every year.

The standard to right a wrong should not be for the IRS to give back the money it stole, but to award triple damages to the citizen wronged by the IRS.

My neighbor forgot to do his Company's quarterly withholding tax.

No Notice

Froze his accounts which had 5 times what he owed but couldn't used the frozen accounts to pay the tax.

He had to personally borrow the money to get rid of the freezing of his Accounts.

Stuff like this is why someone should publish the home addresses of everyone who works for the IRS (and photo, too, if possible), from the highest official down to the capos and then down to the lowest level enforcers.

Are the evils no longer sufferable?
