Alabama Chief Justice Roy Moore says he will continue to recognize ban on same-sex marriage

Alabama Supreme Court Chief Justice Roy Moore has released a letter to Gov. Robert Bentley saying that he intends to continue to recognize the state's constitutional ban on same-sex marriage and urging the governor to do so.

Moore's office released the three-page letter that was delivered to the governor this morning in response to a federal judge's ruling Friday striking down the ban.

"As Chief Justice of the Alabama Supreme Court, I will continue to recognize the Alabama Constitution and the will of the people overwhelmingly expressed in the Sanctity of Marriage Amendment," Moore wrote.

What is this federal judge going to do, send Marshalls to every Clerks office in the state? It’s about damned time somebody stood up to them.

Well the Feds pretty much did this back in Governor Wallace's day over school segregation. I admire the Judge's stand, but I am afraid he will be out muscled when push comes to shove.

I do believe that was the scenario. Federal Marshals would be just as effective. Moore will not knuckle under easily having once been removed from the bench for refusing to remove the ten commandments from his court room. He fought back and was elected back to the bench. but this will likely not end well for him.

Every state official in the country should do likewise and then see how the None will handle it.

Finally! A conservative with guts & balls to stand up against the pro-gay judges and smack them down. Every single blue state governor or state constitutional amendments have rolled over & caved on these rulings from activist pro-gay judges until now. I hope & pray that Governor Bentley will show the same type of courage & response.

Is this an important Constitutional Point, or what!!??

item: There is nothing specific in the COTUS that allows gay marriage. In fact, there is nothing enumerated about marriage at all in the COTUS.
item: There is a specific item in the Alabama Constitution that specifically enumerates what a marriage is in Alabama

Question:
"Can a judicial interpretation of a non-specific ruling document as a whole
take precedence
over a specific item in a sovereign state's ruling document?"

For example, suppose the COTUS said nothing about free speech.
But the Maine Constitution specifically protected it.
Would the Federal Government then have the right to strike down the Maine Law as enumerated in the state constitution?

What is not enumerated in the COTUS, devolves unto the states.
