Fed judge strikes down Alabama bans on same-sex marriage (33rd time a "judge" overrules the people)

A federal judge struck down two Alabama laws banning same-sex marriage Friday, making it one of dozens of states where it is now legal for gays and lesbians to marry.

In a 10-page decision, U.S. District Judge Callie V.S. Granade for the Southern District of Alabama said that an amendment to the state's constitution banning the recognition of gay marriage, and another law prohibiting same-sex marriage licenses from being issued, violated the due process and equal protection clauses of the 14th Amendment.

The Alabama case was brought by Cari Searcy and Kimberly McKeand, a lesbian couple who married in California. Searcy attempted to adopt McKeand's 8-year-old son, but was denied on the grounds that the state of Alabama did not recognize her as as McKeand's spouse.

Calling marriage a "fundamental right protected by the Constitution," Granade said the laws were an "irrational way of promoting biological relationships in Alabama."

"If anything," Granade wrote, "Alabama's prohibition of same-sex marriage detracts from its goal of promoting optimal environments for children."

Alabama is the second state to see such a ban overturned this month. On Jan. 12, a federal judge stuck down South Dakota's voter-approved ban on gay marriage. Alabama's attorney general is expected to request a stay of the judge's ruling, pending the Supreme Court's decision.

"We are disappointed and are reviewing the federal district court's decision," said Mike Lewis, a spokesman for Alabama Atty. Gen. Luther Strange.

It is now legal for same-sex couples to marry in more than 30 states and the District of Columbia.

A renegade federal robed tyrant, this one appointed by RINO George W. Bush, has overruled the will of the people and allowed sodomites to "marry" in Alabama. This makes the 33rd state where robed tyrants have trashed the Bill of Rights and the 10th Amendment, and told the people they know what's right for the state and the people have no say-so whatsoever and they will do what in the hell they are told to or they will go to prison.

And the people take it on the chin! Where are the leaders. To Huckabee’s credit he has brought up this issue. But where’s the revolt?

Hate to say it but it’s going to take some backbone on the part of the bureaucrats.

Down tools. Refuse to issue the certificates. Annoy the judge. If Obama et al want to call in armed troops to enforce gay weddings, of all the pathetic causes, let them try.

Be interesting to see what Alabama Supreme Court Justice Roy Moore has to say about the feds making the State of Alabama issue marriage license to sodomites. The judge is a devout Christian and goes around the country speaking on judicial tyranny and the sanctity of marriage as one man and one woman.

While Moore may have an opinion, this case will not go before him.

Just free thinking for fun - Why don’t the states stop offering traditional marriage altogether and replace it by creating a new legal type of relationship defined as a “reproductive marriage” that doesn’t specify the sex, just that both partners must by definition be able to be isolated together and completely alone and have a probability of producing a baby. If they couple passes that logical test, then it is a “natural, reproductive marriage.” At the same time they would create an “unnatural marriage”, again without specifying the sexes of the partnership, that is based on the logic that no matter how long the spouses are alone together, they cannot procreate naturally without medical assistance. The dictators in black robes have been saying that the states have to apply marriage law equally, not that the states must offer marriage. Create two new types of marriage and watch the judges try to force the states to re-enact a law.

I would think that the only possible solution would be for the Feds to offer a federal marriage which I don’t believe the states are required to honor.
