Supreme Court to Decide Whether Constitution Protects Same-Sex Marriage

Decision Later This Year Could Extend Gay Marriage to All 50 States or Cloud Existing Unions

WASHINGTON—The Supreme Court on Friday said it would decide whether the U.S. Constitution gives same-sex couples the right to marry, signaling what could be the final chapter of a push by advocates to extend gay unions nationwide.

The court accepted challenges to same-sex marriage bans in four states—Kentucky, Michigan, Ohio and Tennessee—that a federal appeals court upheld in November 2014. The ruling by the Sixth U.S. Circuit Court of Appeals in Cincinnati departed from recent decisions by other appeals courts that found same-sex couples enjoyed a right to marry under the 14th Amendment’s equal-protection and due-process provisions.

The justices are taking up the issue in the middle of the court’s current term after having earlier rejected pleas by states to reinstate marriage restrictions that appellate courts had found unconstitutional. The Sixth Circuit ruling, the first to uphold the restriction of marriage to heterosexuals, created a split among the court circuits that didn’t exist in October, making it more likely the Supreme Court could get involved.

The court agreed to hear two specific constitutional questions on same-sex marriage laws and will hear extended arguments.

It can be looked at from two different angles.

One is the Declaration of Independence organic approach. Some consensual concept of God is in there, We might not all agree exactly on it, but we still agree in not picturing this God as hanging trees upside down by their roots from the clouds. There is a sense to the created order.

The other is the isolated Constitution approach. This has no affirmation of a transcendent source of rights, and so rights become whatever men managed to morph them to be.

I don’t bet, but I say it will be 6-3 for SSM in all 50 states and DC, with Scalia, Thomas, and Alito on God’s side.

In the 1950s, I was hit upon in Albuquerque by a homosexual priest while I was travelling across country on leave. Flew in on an Air Force plane and then - was hit upon after midnight at train station, while waiting to continue on to California.

Nice guy ... talked a bit, that's it.

I smell a Roe v Wade coming. All this will do is what Roe did to abortion, which is to shove homosexual marriage down everyone's throat, creating resentment all around: the gays and their marriage supporters will resent that they will never have the acceptance of those who lose the decision, and the rest of us will resent that once again the voice of the people and the limited powers of the Constitution have been trampled upon by those who long ago ceased to be the loyal opposition and became the internal saboteurs.

I hope that this Supreme Court case is not a staged, Alinsky-type setup where so-called pro-traditional marriage attorneys make frivolous points against same-sex marriage.

The Court, in granting cert., actually said that it will decide two questions: (1) does the 14th Amendment require all states to permit same-sex marriages, and (2) does the Constitution require all states to recognize same-sex marriages performed in other states. Question 2 is irrelevant if the Court answers question 1 "yes." So, my own bet is that: the Court will answer question 1 "no" but will answer question 2 "yes"; and that both rulings will be 5-4, with Kennedy in the majority in both.

In effect, this will legalize same-sex marriage in all 50 states, but it will require gays in states like Oklahoma to travel out-of-state to have the ceremony performed; Oklahoma will then have to recognize their marriage when they return. This will permit Kennedy to both legalize same-sex marriage everywhere while still saying that he hasn't abandoned states' rights.

Note also that Romans 1:32 points out that those who approve of such conduct are just as guilty as those who engage in it.

Im afraid your right in that the Federal employees in black robes have little to no respect for the words much-less limits of the Federal Constitution deciding again and again to claim it contains a clause on every matter they can imagination.

It is precisely this lawless tendency of the Federal courts that shall one day see them and their corrupt ‘government’ overthrown as the unbounded tyranny it has become.

If We wanted Washington to be in-charge of every issue large and small, written and unwritten we would never have spelled out any of their powers. If we wanted Washington to have the power to anoint boundless dictators in black robes with power over everything we would not long bother with election much as we wont be soon enough with their results deemed ill-relevant by those dictators.

What we have now with the Federal Court is nether any form of written law insomuch that the Federal Constitutions few and enumerated powers does not include the subject at hand, nor rule of the people insomuch that the people HAVE spoken in the proper state venues on the matter now being usurped from them by the Federal ‘courts’.

Indeed the matter is so wide spread on so many issues from every area of American life that it is becoming increasingly impossible for the people of this once free country to govern themselves. Hence the present drive among our States in earnest toward the only inevitable response to this tyranny... revolution.

It is my hope that the currently corrupt and despotic members of that court live long enough to see the revolution they have already triggered bring down upon them despotism that they have so carelessly created. That the Rest of us live to see freedom, written law, and true justice reborn in what was once before them the land of the free.

These clowns are wasting time and money. The Constitution DOES NOT “PROTECT” homosexual marriage. It’s not in there. Check it out!

They understand that like a autocratic infallible church/cult, what the liberal elite and their judges decide what the says, or meant to say (being part of a form of tradition), and thus removing the right of states to ban sodomite "marriage" means the Constitution prorects this endangered group.

Freedom not Sodom!

There’s freedom in America, the land of the red white and blue;

but there still must be laws, things you just can’t do.

You can’t marry your sister, your brother, or the family pet;

a sheep, or a goat - at least not yet!

That how is it with homosexuality, what the Bible calls sodomy;

men lying with men as with women, is perversity!

That they’re not designed that way, tis easy to perceive,

but yielding to sinful desires, man is soon deceived.

A moral wrong is not a civil right; like the sin itself, that’s confusion;

calling evil good and exchanging light for darkness, is sure delusion!

History tells us where this will lead, from societies now in dust,

When a nation casts off the laws of God, and follows it’s own lusts.

Promoting a sin which sends one to Hell from an early grave,

dishonors God and robs man of the Life He gave.

There’s but one answer: the Risen Jesus gave Himself for our sins;

Repent and believe, then truly follow Him!

As I recall, at the time of Lawrence v Texas (2003) the dissenting opinion suggested that the decision to disallow states to criminalize homosexuality would lead to recognition of Homo-marriage. That dissent was widely proclaimed by the majority on the court and the liberal establishment as unfounded and fear-mongering. So it seems as the view of the court was known in 2003, that being the constitution does not require recognition of faux-marriage. What in the constitution has changed?
