I hope the mayor sues both the City of Atlanta and the mayor separately, as an elected official. It is very difficult to see how this is not a violation of 1st Amendment rights to free speech and freedom of religion. And using the bare possibility of future legal action against the city as a rationale, with no evidence of discrimination by the chief personally, is equally outrageous.
