Veteran’s Guns Confiscated After He Sought Treatment for Insomnia

Donald Montgomery is a Navy veteran and accomplished NYPD detective.Montgomery claims in a recently filed lawsuit that after several visits to the hospital and his primary car physician for symptoms of insomnia and stress following a move his firearms were confiscated under New York’s SAFE Act.

In fact, several notes in Montgomery’s medical files specifically say that he is not experiencing suicidal or violent thoughts. Montgomery was ultimately diagnosed with insomnia and mild depression (possibly caused by the insomnia), but otherwise no mental health issues were ever mentioned.

It’s unknown at what point Montgomery’s files were handed over to the state or who transmitted them, but under the new laws that doesn’t matter.

Why do people live in the People's Republic of New York? This fellow served his country & state, However, this is the thanks that he gets in New York, And what excuse does New York use to confiscate his guns? Insomnia!

I wonder also if he voted for democrats.... Its rather likely given the political climate there. Even so voting republican anymore is a crap shoot. Most are closet democrats...

On the plus side, he’s fortunate enough to have a primary car physician.

I can’t afford to take my automobiles to the doctor.

No one had to "hand them over".
This is likely one of the expected results of instituting electronic medical records.

All a state agency has to do is run a nightly job querying the database for who has popped up matching a set of criteria, including the word "depression".

The damn computer probably auto-routes the file (with address) to the local SWAT team and they have their mission for the day.

It was as plain as the nose on your face when they started putting medical records into a database regardless of promises of strict controlled access - the government always has a back door.

They couldn’t get their way for outright seizure, so they vowed to seize legal guns anyway. Soon if you get some excedrin they will come to your house looking for firearms.

I agree. The requirement for electronic health records is a huge red flag. Government intrusion into matters they have no business under the guise of Obamacare is so obvious.

that’s the headline right there. the depression listing is why. that has been one of the reasons all along for disarming vets.
