In the first legal ruling of its type, a federal appeals court in Cincinnati on Thursday deemed unconstitutional a federal law that kept a Michigan man who was briefly committed to a mental institution decades ago from owning a gun.

The court ruled correctly. Despite this, I would be very cautious before getting mental health “assistance”. Just as there are times when a reasonable person might choose to deal with a bacterial infection without antibiotics, a reasonable person might choose to deal with a broad range of problems without seeing a shrink. The social stigma, and the abuse of power by liberals who would use that as leverage to deny those with a record of mental illness may be too high a price to pay for whatever benefit treatment may provide.

I've been hearing about doctors asking "mental health" questions questions along with those about if you have any firearms in the house.

My standard answer when someone asks me if I'm depressed is "No. I own a motorcycle."

Two big things that I get from this decision are:

1. Second amendment rights are fundamental and subject to strict scrutiny.

2. Temporary conditions are not valid reasons for permanent disabiility of rights, unless a clear means for recovering those rights is provided.

“The government’s interest in keeping firearms out of the hands of the mentally ill is not sufficiently related to depriving the mentally healthy, who had a distant episode of commitment, of their constitutional rights,” wrote Judge Danny Boggs, an appointee of President Ronald Reagan, for the panel.

Reagan's legacy isn't completely dead. Scary to think that Obama's appointees will still be with us 30 years from now though.
