Justice department is not in the loop at all.
US Marshals assigned to Judge’s Court carry out enforcement for Courts.
The Federal Judiciary is completely independent in all its operations save for one reliance written into the Constitution which is ultimately a question of budget that comes from Congress.
So there is no need to be concerned that a Judge will not be equipped to carry out justice.
The wildcard in all of this, if one is inclined to look for such things, is the question of whether the DC Judge will follow the law or not. The DC Judge assigned to this case has a pre-judgeship background that is a cause for concern but maybe not. No one really knows. The concern is that this Judge is reported to have been at one time a lead counsel for Patrick Leahy, the notorious liberal politician. But that doesn’t mean much if a Judge has a reputation for following the law. If this Judge follows the law next week, then Obama’s people and contractors are stopped. If this Judge does not follow the law but instead twists Obama’s narrative to fit a political goal, then Klayman I am sure has prepared an immediate appeal, at least I hope so.
Two things that are positive but not really meaningful because ultimately it’s a toss of the coin, are that the Judge assigned to this case did in fact grant over Obama’s lawyer’s objections, plaintiff’s request for fast track which is why the hearing is to be held this coming Monday.
The second thing is that Klayman who is the lead plaintiff counsel, is experienced and successful in DC Courts.
But again we can all be surprised so I am not raising my expectations. I will just watch the play by play.
Oh, and of course the US Marshals are not going to be arresting or serving summons on Obama or his White House. They will be serving such on federal employees and on federal contractors.
The fact is that Obama cannot carry out his executive actions without people. If those people are stopped by a federal court order, then Obama is effectively stopped.
