Grand Jury Declines to Indict NYPD Officer in Eric Garner Chokehold Death: Sources

A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.

In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

This is interesting:

STATEN ISLAND, N.Y. — Despite his contention of a frame-up, Ramsey Orta’s testimony didn’t sway a grand jury, which indicted him on weapon charges, stemming from an Aug. 2 arrest, it was revealed in court Friday.

Orta, 22, who filmed an NYPD officer’s fatal chokehold of Eric Garner last month, pleaded not guilty at his arraignment in state Supreme Court, St. George.

Most interesting. Less than a month after Garner was killed, the same DA’s office tasked with handling his homicide case just happened to get a grand jury indictment against the man who filmed Garner’s homicide.

How convenient.

“The coroner found no damage to the trachea or bones in the neck.”

But did find hemorrhaging in the neck. This guy was no athlete and probably had a lot of health problems that probably contributed to his death, but that doesn’t excuse the actions of the police.

Just got done discussng this with a retired LEO while on a call. He said it ended up being a chokehold when they fell to the ground and the NYPD officer appears to tighten his hold.

Made the same comment arou the failure to render aid/assistance after Garner was clearly in some form of distress. Shameful.

I’ll have to watch that part of the video again. The ambulance was there in 4 mins I believe. There’s not much they could have done except get him in a more comfortable breathing position.

chokeholds are illegal because this kind of thing can happen, if the chokehold caused his death then this cop should have been charged with manslaughter or reckless endangerment.

...

Garner was very obese, and had asthma. He physically resisted arrest. There was no damage to his trachea or the bones in his neck, and was conscious after he was taken down, so I don’t think the officer caused his death.

Yes, I saw that, but Garner could still breathe and talk after he was down. The coroner didn’t seem to find any damage that would indicate a choke in the medical sense.

The guy is dead and his death was ruled a homicide by an illegal choke hold by the coroner and forensic experts. So in this case, pretty damn serious.

You have to remember, this is NEW YORK CITY!!!

Everywhere Democrats rule you get screwy laws. Who knows, maybe the guy also tried to buy a Big Gulp or something. Or maybe he used salt in a restaurant.

I would need more information, but a guy that obese who is unconscious from nothing more than being taken down and handcuffed needs to be treated as if he is in a life threatening condition.

Granted, the police have to probably keep him cuffed according to policy. After all a perp can fake it, too.

Okay, just to ME, it seemed a WHOLE LOT more reasonable to object to that choke hold when that guy wasn’t presenting a threat.....and there were, IIRC, several cops on the scene.

Plus, wasn’t the guy selling cigarettes without a permit?! I mean, how does that justify a choke hold?

Anyway, that is my opinion.

This has nothing to do with Ferguson...In that case ya had big lumberhead actually trying to kill a cop...The shoot was perfectly 100% legitimate.

In this case ya literally got a crowd cops jumping on some guy for....gasp, selling loose cigs...They jumped on him because he did not obey and allow himself to be chained up and caged for the cig sales.

This was all about, "Obey us now" and they got very physical with him. He died in the process and was not trying to kill or hurt anyone. Some of the cops at the scene thought this was all quite funny until the guy stopped breathing.

There are thousands of MINOR situations just like this where people are not trying to harm anyone, but many cops have this mentality where you must be obey or else. And in the end, in many cases they just make things worse and in many cases, tragically worse

Obey or else, is the message.

All this because the man did not want to be caged for selling loose cigs on the street.

Meanwhile the well connected corrupt wearing nice suits swindle millions out of trillions in taxes.

I have not yet seen the video but I heard audio clips of Garner choking out the words ‘I can’t breathe’ several times over. Police may have gone a little overboard on this one.

A criminal refusing to surrender to handcuffs and taken to a police station. He should know better than resist and committed his own death.
