You are correct about the timing. It reminds me of the hoorrible Benghazi story being held back from America so Herr Obozo would be re elected.

However, there is nothing we can do about that.

We can skewer the rats with Gruber Gate until they develop a chronic problem to make them totally irrelevant.

SEC. 1401 of the ACA creates section 36B of the Internal Revenue Code

36B(b)(2) specifies the premium assistance amount is equal to the lesser of SEC. 36B(b)(2)(A) or SEC. 36B(b)(2)(B).

SEC. 36B(b)(2)(A) is explicitly specified as applying to an Exchange established by the State under 1311.

For SEC. 36B(b)(2)(B) to be given effect SEC. 36B(b)(2)(B) must necessarily also refer to Exchanges established by the State under 1311, otherwise 36B(b)(2) would be meaningless because a taxpayer can not be enrolled in both a state and federal exchange and whichever is the lesser amount applies.

The proposition that SEC. 36B(b)(2)(A) “Exchange established by the State under 1311 includes “Exchange established by the Federal government under 1321 is absurd. Equally ridiculous is that “Exchange established by the State under 1311 simply be read out of SEC. 36B(b)(2)(A).

Courts would have to do one or the other, introduce absurdities or read out of the statute clauses, in order for the act to satisfy what an agency, the IRS, claims is Congress’ intent. The law is not ambiguous or unreasonable, Congress’ intent is clear. There are no "errors" for the judiciary to correct.

The court can not reconstruct a statute to satisfy an agency’s claim.

The act explicitly provides tax credits for state-run exchanges and excludes such credits for federally run exchanges.

The democrats even used the “Cadillac Tax” scam to bilk health insurance customers out of increased premium payments. The way it happened was the insurance companies were charged a 40% tax on health insurance plans considered premium level. This tax was, of course, passed on to the customer in increased premium payments. In effect, the customer paid the tax and blamed the insurance company for jacking up the rates. The Democrats snickered at the trick they played on the gullible public. Now their tricks are coming to light. Their efforts to hide their criminal conduct is unwinding.

The Democrats need a courtesy flush. Gruber and his fellow vermin have fouled the political atmosphere for too long. Their toxic effect should have prompted an EPA hazmat alert and an Al Gore money maker stench trade scheme. May the American people put the Democrats and Obamacare into permanent flush mode.

Quentin Young, Bill Ayers, and Barack Obama all live in the Hyde Park neighborhood of Chicago. Young attended the fund-raiser in communist and terrorist Bill Ayers home which launched Obama's political career. Obama was brought to that fund-raiser by Alice Palmer, a known communist. [11][12][13]

Obamacare architect Jonathan Gruber advocates for single payer but it is "politically a non-starter". [15][16][17]

DSA member Gerald Friedman (and Professor of Economics at the University of Massachusetts) says, "after [the ACA] fails, we will finally do the right thing: single-payer health insurance."
