Judge vows to stay despite election loss

State District Court Judge Sheri Raphaelson, rejected at the polls on Tuesday, says she’s not going anywhere and that she plans to stay on the bench through 2016.

In Tuesday’s general election, voters in the 1st Judicial District – Santa Fe, Los Alamos and Rio Arriba counties – voted against retaining Raphaelson. She needed to get 57 percent of the vote to keep her job and came up just short, with about 56 percent voting “yes” on her retention.

But Raphaelson now says she should never have been on the 2014 ballot in the first place and that she was not due to face voters again until 2016. And she maintains three other 1st Judicial District judges shouldn’t have been up for retention either, because none of them has served a full six-year term on the bench.

This reminds me of the famous 1944 photo of then Montgomery Ward president being carried out of his downtown Chicago office by two National Guard soldiers obeying unconstitutional seizure-orders of the retail chain issued by an arrogant FDR.

If someone has this iconic photo and can post it, it would portray a splendid example of what should happen to the above defiant judge if she illegally overstays her office.

Too much power corrupts too many arrogants who currently populate our society's ruling class.

Thanks, Piasa, for the link to the iconic photograph.

Montgomery Ward president Sewell Avery, in my opinion, was correct (and ahead of his time) in fighting FDR's federal government's usurpation of power, his kowtowing to unions and his unconstitutional executive action.

Kinda like what we're experiencing today under the arrogant Obama regime with its merry band of fascist thugs.

Wow?! Does anyone here care to check her claim, that she was supposed to even be on the ballot or do you just wanna bash a dem?

Raphaelson was re-elected to the First Judicial District. She defeated Yvonne Kathleen Quintana in the Democratic primary election, winning 60% of the vote and ran unopposed in the general election.[1][4]

Sheri A. Raphaelson is a district court judge in the First Judicial District of New Mexico. She was appointed to the court in 2009 by Governor Bill Richardson.[1]Her current term ends in 2015.

Does she have a case?

Supreme Court: 8 yrs
Court of Appeals: 8 yrs
District Court: 6 yrs

The article says this was a state mandated RETENTION election that all judges are obliged to every 8 years regardless of their term. Seems voters did not wish to keep her. And she does not wish to obey state laws.

Simple, have the county sheriff issue a warrant for her arrest for trespassing on government property (the court house) More than that, she woould be committing the crime of impersonating an officer of the court. Felony??

The retention elections for all district judges are held every six years, with the last one in 2008, he said, and every judge who’d been previously elected was up for retention regardless of whether he or she was at the end of a six-year term.

Some other judge will have to make a ruling on this, but it seem pretty clear to me now, she lost the retention election and regardless of her remaining term, she's gone. Why else would they have, "retention elections if you could serve out your the full term?"

Thanks I got the time of retention elections wrong. Kind of sounds like how Clinton acted the day Bush was inaugurated...one long winded speech after another I thought he would never leave. Democrat way no law applies to them.
