BREAKING: Judge eases some restrictions on Maine nurse being monitored for Ebola

A judge issued a new ruling Friday that removes some of the restrictions placed on Kaci Hickox, the nurse who the state has been trying to quarantine since she returned to Maine earlier this week.

David Soley, a partner in the Maine law firm Bernstein Shur, which is representing Hickox, said that the judge issued a moving oral decision that sets conditions for Hickox that she has intended to follow all along.

The new restrictions call for direct active monitoring of her condition, coordination of travel with public officials and a requirement that the state be alerted as soon as Hickox develops symptoms, Soley said. It does not prevent her from leaving her house or being in contact with other people.

The new rules will be in place until a full hearing on the state’s petition, which is scheduled for Tuesday – Election Day.

“The judge issued a very beautiful and moving order in the case. I listened with tears in my eyes,” Soley said.

“He said basically we wouldn’t be here today but for a woman who cared for and comforted people who are stricken with a terrible disease,” Soley said, referring to Chief District Court Judge Charles LaVerdiere’s oral decision. “He was aware of misconceptions and bad science being spread from shore to shore.”

“The judge said people are taking actions out of fear that is not rational and inappropriate,” Soley said.

Whether she had contact with Ebola patients or not, it's pretty unlikely she was infected. She ran a fever one time, then came back negative and had no fever. Then there was a big time overreaction. She should have been given an instruction sheet and sent on her way.

While we watch this theatre, there are 150 potential Ebola infections coming in every day with far less medical knowledge. Some will be infected like Duncan and completely clueless. Those are the people that need quarantening.

A small percentage of HCWs get ebola from patients. In the USA it was 2/70. In Africa maybe 10% but less if you only look at foreign HCWs.

It is the Executive Branch, which of course is Obama, that is the only political entity in the country that may have the power to impose a quarantine.

And here we have Conservatives essentially saying, “Please Mr. Obama, start forcing American citizens into locked quarantine and we don’t care about the science, we just want you to use your own arbitrary standards of who who you lock up in quarantine and please do not use Due Process.”

Hypothetical of course....Obama called her and said that if she does come down with Ebola, they have reserved 2 doses of Zmapp for her.

Are you sure? One would think a county health department would have the ability buried in their regs somewhere. I can understand a national entity having the ability in the event something big struck, like if ebola goes airborne, but monitoring and enforcement would have to be local and so that would seem they would have the ability.

I don’t understand the hubbub. Frankly, this person was asked to stay home and watch tv for 3 weeks. Not like she was being put in a padded cell.

give the Executive Branch, that would be President Obama, the power to quarantine American citizens, without using Due Process, and without scientific evidence.......They are NOT “giving” anything. Quarantines have been a large part of American history starting with Ellis Island, quarantining rangelands out west because of anthrax, to scarlet fever to measles, mumps and you name it. The so-called ‘experts’ in government(the Progressive model)are not in control here, but prior HISTORY should be.

I think one thing that bothers me is that the CDC and the WHO, both political entities, issue confusing protocols. They want people to be quarantined for 21 days in certain circumstances, and not quarantined at all, given those same circumstances.

Dr. Brantley tested negative for Ebola on his first test once he started feeling poorly, but was positive soon after that. He has stated that he is certain he became infected while examining patients who were not in isolation, and who hadn’t been diagnosed with it yet. So clearly they were infected without knowing it, and before they had a fever. They passed it on to him while asymptomatic.

I wish we didn’t have one case of Ebola anywhere, but we do, and I don’t want it to spread. I wish the CDC, DWB, the WHO, and all of those entities would start telling us the real truth...that there’s still a lot to learn about Ebola.

Well if she is as other people are comparing her to like Fluke then take a random pick of possible STDs. Other than that the obvious... EBOLA. Her roommate had it... she HAS it.

Watched that segment on 20/20 about the nurses that cared for Duncan and they seemed like dopey medical people who were all proud of Duncan and how nice he was, not that he lied or brought a disease here that never was here to begin with. Anyways they said it was 3 gallons of diarrhea every day from him they had to clean up, never said how many gallons of vomit though. Even after that they were singing praises for Duncan. I was appalled. That kind of body fluids mixed with sex would be like being in a WAR ZONE.

You and Cold Case are always downplaying Ebola and always siding with the ones with Ebola. This woman is playing Russian Roulette with the rest of the Amaerican population because like a spoiled brat she doesn’t want to be told what to do. If you care for Ebola patients, know that you will have to do a 21 day quarantine and in my mind they should double it just to be sure.

According to the first stories about Hickox, her last patient was a 10 yr old girl. The girl was dying & having seizures, and Hickox gave her Tylenol & anti-seizure meds.

If accurate, that sounds like contact with Ebola patients, doesn’t it?

Then again, maybe that first story was a lie, to make her more sympathetic to the public. Who really knows?
