Congress should deem the printing of such cards ‘fraudulent’ and therefore unlawful because they themselves did not initiate the order!

Well they can certainly restrict that DHS spend no funds on this effort since it has not be authorized by congress.
Since there have been no funds appropriated by congress for this program, the issuance of the RFP or RFQ may be illegal. Redirecting funds without congressional approval is a Bozo NoNo.
