Why Darren Wilson Isn't in Cuffs

All of the most recent protests in Ferguson over the slaying of Michael Brown seem recent since the protestors have all asked for the same thing: That is to slap the cuffs on Darren Wilson, the officer who gunned down Brown on August 9. The reasons given for Wilson's freedom by some are that the prosecutors and cops almost never arrest and charge other cops with misconduct, the St. Louis County Prosecutor is a bigot, and there's no smoking gun piece of evidence to base an arrest on.

These are all powerful blocks to clamping the cuffs on Wilson. But they aren't the prime reasons. The single biggest barrier to arrest and prosecuting police officers in the use of deadly force in the shootings of unarmed civilians -- even those who have committed no crimes or are even suspected of crimes at the time of the shooting, as is the case with Brown -- is the ancient self-shielding uttered by the officer of the magic words, "I feared for my life or the life of others."

These words are codified in law in many states. Missouri is one of them. It's called the Missouri Defense of Justification Statute. It flatly says that an officer can use deadly force when "he or she reasonably believes" it's necessary to protect life. The operative words are "reasonably believes." Translated, that means that there is no written code, rule, or guideline for what exactly reasonable belief is or means. It's purely a judgment call by the officer at the moment he or she draws his or her pistol and opens fire....

His father, Earl Hutchinson Sr., is the lead author of A Colored Man’s Journey Through 20th Century Segregated America. His daughter Sikivu Hutchinson is a feminist atheist activist and author.

Hutchinson has taken part in the controversy about Pope Pius XII and the Holocaust, accusing the former pontiff of being complicit in the crimes of the Nazis and opposing his sainthood. He is a regular co-host on Al Sharpton’s radio show.

During a segment on Al Sharpton’s radio show, author and regular co-host Earl Ofari Hutchinson identified GOP rising star Ben Carson as a “black racial hit man” for conservative views, a figure who can make pointed and controversial statements with less fear of reprisal than a white conservative.

Maybe we don’t need police? Who is going to take the job if we tell them they cant protect themselves?

Maybe robbery and assault should be made illegal?

Obviously the officer (or anyone else for that matter) has to decide for themselves. If a prosecutor disagrees they can try to convince a jury that it wasn’t a reasonable fear. That’s the same as self-defense law here in CA.

Its the American Idol crowd’s application of Justice in a Rainbow World.

They ignore facts, vote with emotions, and to hell with the rule of law. They are closed minded. They are always right an it’s like arguing with a tree stump to convince them otherwise. They exercise rights that others do not have.

They can’t deal with the truth, can’t think for themselves, and are told what to do and say. Yet, they believe by playing the blame game, society can trade them immediate justice (and respect) for their peace. It cannot, they must earn it and show some responsibility and respect for themselves and others.

They are uneducated (some low IQ), have no common sense, and skills to survive off the government plantation. Yet, they believe they can continue to survive by taking from the producers. They will not, because resources are finite and the number of producers is declining.

They are not going to like the Real World and when it slaps them in the face. Are you ready to face this reality.

They are in for a rude awakening for sure. I suspect that 6 out of 10 of them will end up starving to death and the other four will not die of natural causes. But, when one sows to the wind, one reaps the whirlwind.

Sad to say even if Wilson goes free (and from all the evidence shows he should) he will have his life ruined. Zimmerman says he has to move all the time and be very careful where he goes because of constant death threats.

Yeah maybe. But then again maybe we shouldn't have a country where people who were acquitted and deserved to be acquitted have to live in fear of black racist lynch mobs.
