Candidate in court after sawing garage in half

The Republican candidate for Minnesota House District 6A on the Iron Range faces a civil trial in Itasca County this week after sawing his neighbor’s garage in half. Roger Weber of rural Nashwauk is being sued by Mark Besemann of Iron after Weber used a power saw to bisect the building. Weber then removed half of the garage he insists was built, decades ago, on property that he now owns. Besemann is suing Weber for $20,000 in damage to the garage and $20,000 in punitive damages. Besemann also is seeking a small portion of Weber’s land adjacent to the garage to act as a buffer to any additional actions Weber might take.

State District Court Judge Lois Lang is scheduled to hear the case Monday and Tuesday in Grand Rapids.

On Oct. 3, 2013, months after the garage had been halved, Roger Weber paid to have the land re-surveyed. Indeed, the correct property line between what had been Robert Weber’s land and Roger Weber’s land runs about halfway through the garage, almost exactly where the garage was cut.

ALWAYS have a recent survey and a couple of markers that match it.

In some areas, the fact that the garage had been there for more than a decade would put into force a property easement.

You need two people when you buy....a surveyor and an attorney. A good attorney will hire the surveyor who will map it and any problems. Appears that Besseman knew there was a problem. It should have been resolved before he bought it.

Cut the garage?? Works for me.

Wish he could have waited until after the election. Oh well, I guess a Republican doesn’t stand a chance in the Iron Range anyway.

It sounds like Weber failed to have a survey done when he bought the property, and failed to act on the encroachment. In most states, failure to take action on encroachment cedes the right to the property. I don’t think that Weber is going to like the outcome.

Wow, I did not realize the guy that surveyed my place worked that far away.

Mine did a drive-by survey and managed to miss the back fence by hundreds of feet. So he just went down to the tax office and filed a new survey and never bothered to mention it to anyone.

People will be cursing his name for a hundred years trying to fix his many screw-ups.

We had an asshole neighbor at our first house, always drunk, and trying to start a fight, or get money out of us. His mother Mrs Butterfrass - real name - WANTED the fence where we put it, on a straight line. We all agreed to it.

Well sonny boy who was an “adult”, moved in with mom, and the house was in His name, so that Mrs Butterfrass’s ex husbands couldn’t claim it, so we knew he would never leave. He was once again drunk and came over threatening us if we didn’t give him money for that fence line. He was bloody, drunk, bruised, and had obvious stab wounds in his arms/sleeves, etc.

He thought we had money for some reason. We didn’t. So we called the cops, and they were very familiar with Mrs. Butterfrass’ son. Mrs. B refused to come outside, she was so embarrassed. She wanted the fence there.

We had that fence removed and had a TALL wooden fence put in directly on the property line.

We moved to a much nicer house in a nicer town in a beautiful neighborhood! I should thank that ole drunk....

That is correct, actions like this (sawing) don't generally work out so well.
