Grand Jury Process Raises Questions About a Ferguson Indictment

The ongoing grand jury proceedings may suggest the prosecutor is trying to avoid backlash if Wilson isn't indicted.

Officer Darren Wilson testified this week in the grand jury investigation into his shooting of Michael Brown, according to the St. Louis Post-Dispatch. The newspaper’s scoop was unusual. Unlike most criminal-justice proceedings in the U.S., grand juries are highly secretive. Leaking information about them is a criminal act.

But perhaps it should no longer be surprising to see the investigation take an interesting turn. More than a month after Brown’s death in Ferguson, Mo., the grand jury appears to be nowhere near a decision on whether Wilson should be charged. And the road to justice has been paved with strange decisions.

Several elements of the grand jury’s proceedings have been uncommon, according to legal experts surveyed by TIME. None of these decisions are necessarily improper. But together they have raised eyebrows. “This is not your regular St. Louis grand jury case,” says Susan McGraugh, a veteran Missouri criminal-defense attorney and law professor at St. Louis University....

So, what will he do to make sure a certain ethnic group does not riot? Previously mentioned ethnic group will remain un named of course, but what will he do?

Yeah, I think he’s definitely trying to CYA. I don’t think it’s going to work, though. McCullough might be able to keep his hide in one piece with City Hall types, etc. But if the GJ decides not to indict, all the record keeping and media leaks in the world aren’t going to mollify those in the media and among the Ferguson protestors who want the proverbial pound of flesh. Someone who has already tried and convicted Wilson in their own mind and heart isn’t going to listen to any evidence to the contrary.

I miss the rule of law. It's not compatible with Obama's world, so I don't expect it to return in the next 28 months.

The article is misleading as all getout. Witnesses who appear before a Grand Jury are allowed to talk about their experience. The only people bound to secrecy are the grand jurors. There are probably thousands of examples of news stories where a person told the reporters what they said to the grand jury.

This is how the Duke kids got Nifonged. The Black Justice Brothers come to town and these elected prosecutors pee in their pants. Don’t elect DA, select them. so that they ain’t politicians and maybe we won’t have the Officers Crucified
when they have to use lethal force on a minority.

A grand jury is a very good thing for innocent people. It is always said, “A prosecutor can indict a ham sandwich”, but not always true. The accused gets to address the grand jury directly without the filter of attorneys. Been there.

Exactly. ...Glad I checked through comments to see if anyone else would post what I was going to say.

I spent an hour or so in front of a Federal Grand Jury of about 30 people, responding to a Fed Prosecutor and his two assistants. ....Members of the GJ are not permitted, by law, to disclose what transpired. ....I was permitted to disclose the questions and answers during my time in there.

“McCulloch has pledged to immediately release full transcripts and audio recordings of the panel’s testimony in the absence of an indictment. This too is highly unusual.”

I would say there isn’t grounds for indictment and
McCulloch is setting it up so that the evidence will be
released immediately after. The sad fact is that the people
they are trying to appease don’t care if Wilson is innocent,
they want asacrifice, an eye for an eye.
The police chief should go public and remind the people
of their right to bare arms and protect their property.

Ever heard of Travis county Texas. I believe that is where
the term was hatched.

Papa Bush siced his justice department on Koon, Powell, Wind, and Briseno on the charge of violating the civil rights of Rodney King. Koon and Powell were found guilty on
one charge of violating King’s civil rights.

That’s a Bush, you think the Obama and Holder will have
a problem with Wilson’s sacrifice?

On the other hand, the Obama and Holder may want a pass
on Wilson. You’ll know if they tell the DA not to release
the transcripts insuring rioting.

EXACTLY! The Street Rats have “terrorized” the neighborhood sufficiently to sway even a Grand Jury's decision. IMO, the entire Grand Jury proceedings should have been moved far away from St. Louis County to avoid any "conflict of interest" by its citizens trying to CYA and avoid further "happenings" by the "All Hell Will Break Through", Street Rats.

Here's who needs to be indicted, for extortion. Speaking in code with his thug whistle word, discontent means violence, and civil disobediance means looting/rioting

Of all the boxing movies I have seen, classic films going back to the 30`s..This imho is the best one ever, not to mention that it`s a true story

Even my 90 year old mother enjoyed it
