Mississippi high court to hear arguments Oct. 2 in McDaniel election challenge (GOP-E Vote Fraud)

JACKSON — The Mississippi Supreme Court will hear oral arguments Oct. 2 as a candidate tries to revive a lawsuit that challenged his Republican primary loss to six-term Sen. Thad Cochran.

The high court has released a schedule for the appeal by state Sen. Chris McDaniel. Justices said they will handle the case quickly, as McDaniel requested.

Justices gave McDaniel’s attorneys until Friday to file legal arguments in his appeal. They gave Cochran’s attorneys a Sept. 24 deadline to file arguments. The McDaniel camp must file a response to Cochran’s arguments by Sept. 26.

Judge Hollis McGehee dismissed McDaniel’s lawsuit Aug. 29, saying McDaniel missed a 20-day deadline to challenge results of the June 24 runoff.

Certified results show Cochran won by 7,667 votes. McDaniel, who is supported by tea party groups, claims the runoff was spoiled by voting irregularities.

State election officials have prepared a Nov. 4 general election ballot that lists Cochran as the Republican nominee, former U.S. Rep. Travis Childers as the Democratic nominee and Shawn O’Hara as the Reform Party candidate.

State law says the ballot was to be given to counties by Wednesday, which is 55 days before the general election. Absentee ballots must be ready weeks in advance to send to overseas military voters.

No judge has ordered a do-over of a statewide election in Mississippi. If the Supreme Court overturns McGehee’s ruling and sends McDaniel’s lawsuit to trial, McDaniel would have to prove that the election was so sloppily run that its outcome could not be known. McDaniel’s lawsuit asked the judge to declare him the winner of the Republican nomination or to order a new runoff.

Mississippi law says a new primary could be ordered even after someone wins the general election. If that were to happen, a new general election also would have to be held.

McDaniel led a three-person Republican primary on June 3. Turnout jumped significantly for the runoff three weeks later, including in predominantly African-American precincts where Cochran fared well.

McDaniel had called the runoff a “sham” and criticized Cochran for appealing to voters who traditionally support Democrats. His lawsuit said Mississippi GOP officials violated the rights of Republicans by allowing people to vote who didn’t intend to support the party’s nominee.

Cochran campaign spokesman Jordan Russell said McDaniel’s lawsuit was “baseless.”

It looks like the Miss. State Supreme Court has taken up Chris McDaniel's claim of vote fraud. That's good. It should not stand. Cochran should not win.

McDaniel needs to make very clear to the power structure that he will ratchet this up right through the election....no matter what the Miss. Supreme Court decides.

I agree with you. If McDaniel cannot get Cochran thrown off the ballot, then Mississippi conservatives need to send Cochran down in flames by voting for the Pro-Life, Pro-Gun Democrat.

The larger movement cannot afford to let the Mitch McConnell\Cochran people get away with that tactic they pulled. It has to be demonstrated to them that making such horrible false accusations against McDaniel will result in a guaranteed loss.

And we need to make it clear to the GOPe that we will hold them accountable everywhere we can, in every primary election from now 'til doomsday. RINOs get no free passes ever again.

That would definitely be a popcorn event. I’d prefer that Cochran be disqualified and McDaniels declared the winner, but I’ll take a follow-on new election if that’s what it has to be.

Did McDaniels ever prove enough fraudulent votes to overcome Cochran’s margin of victory? Last I read their guestimate of wrongful votes at the time was very close to overcoming the margin.

Also, does McDaniels in this Supreme Court suit take on the R Party rules abuses of taken against him?

There has been so little coverage of the fullness of McDaniels final prepared case.

I’m so thankful McDaniels has persued this to the ends of the earth!

For the State Supreme Court to take this up, McDaniels accumulated evidence had to call the primary into question.

I think he had about 7800, which was enough, iirc, and he claimed additional gross irregularities in the absentee ballots. Those combined must have decided the minds of the Miss. Supremes.

Nine Supreme Court justices are elected from three districts. Non-partisan
elections are staggered so that not all positions are up for election at once.
Supreme Court justices serve eight-year terms.

Each Supreme Court justice participates in deciding appeals from the entire state.
Decisions are by a majority vote of the court.

How about not voting for the Democrat and leaving the top of the ballot blank. That would send a broader message. It’s ridiculous to vote for a liberal BECAUSE the other candidate is too liberal. Makes no sense. Conservatives refusing to vote FOR Cochran will still swing the election to the Democrat, which will send a clear message. But, it will also not make us look hypocritical.

Sadly you will get neither, that is my prediction and I am sticking to it.

Vote for the democrat if you have to, because;

Voting for a Progressive RINO is the same as voting for any other Tyrant.

The Mississippi ballot has a plce for a write in and it can be used, it will not be counted. I’m going to write in Chris McDaniel, even though it will not be counted as anything other than a “NO Vote” it will be a statement, especially if there’s a large number of write ins. I will not vote for cochran or childers. childers is not conservative anything, he’s a democrat and will ultimatly vote the party line when the vote counts.

Not voting does one vote worth of damage. Voting for the opponent does TWICE the damage. If you've made up your mind to do damage, why do it half way?

It’s ridiculous to vote for a liberal BECAUSE the other candidate is too liberal.

It is not being suggested that people should vote for the Democrat because Cochran is too liberal. People should vote for the Democrat because the Racist tactic that the Cochran campaign used is a dire threat to the future existence of the Tea Party, in Mississippi and elsewhere.

If McConnell\Cochran get away with this, they will use this "The Tea party is RACIST" tactic in future elections elsewhere.

Nor is the tactic about revenge. It is about preserving the future viability of the Tea Party. What the Cochran campaign did is an grave threat to the entire Tea Party, not just the one in Mississippi. We have to make an example out of Cochran to preclude this tactic from being used again.

Yes he will, and the Republican Party establishment that deliberately attacked the conservative candidate needs to be made to FEEL THAT PAIN when the Democrat votes against them because they meddled in the election.

The GOPe stabbed conservatives in the back with that underhanded Racist tactic, and they need to be made to suffer for it else they will do it again elsewhere.

At this point it is more important to punish traitors than it is to tolerate them. They need a revolt, and right now the only tool we have is the opposition candidate.
