A 16-year-old boy who was being driven to a hospital by friends after he was shot at a San Jose party died because police officers stopped the vehicle and then failed to provide medical help, the boy's father said in a federal civil rights lawsuit filed Thursday.

Gerardo Jorge Medina was struck in the stomach by a stray bullet fired at a party on the 10300 block of Murtha Road in eastern San Jose on June 13, 2013, according to the suit filed in U.S. District Court in San Francisco.

Are you saying that the cop was justified in not getting medical care for the (now dead) teen because the father shouldn't have had the boy in that situation?

Because that's what it sounds like you are saying.

So the cops stop a car full of gang bangers speeding for an unknown reason and they are at fault? How about the kids use common sense, call 911 and get trained paramedics on the scene. Also the cops could be a little cautious as gunshots obviously occurred in the area.

Sounds like nobody knows enough details about the case to pass judgment.

So why didn’t the kids call 911 for help instead?

How about suing the shooter, I some how think that person is much more responsible for this person’s death.

@montaramike
Don’t be rational. It will confuse the cop haters.

ROTFLMAO!

From the article, it sounds like the cops did call for medical assistance as soon as they realized that the kid was really hurt.

In some places, calling 911 is a long wait where a train don't come.

When I was coughing up blood, it was faster to have my daughter take me to the ER (and much cheaper) than call 911.

Call 911 and the pizza delivery place. See who gets there first....

My first suspicion is that there was under-aged drinking, perhaps drug use, going on at the party. The last thing they wanted was a bunch of cops to show up responding to a gunshot 911 call.

“So the cops stop a car full of gang bangers speeding for an unknown reason and they are at fault?”

Cops aren’t allowed to have an “unknown” reason. They need a little thing called “probable cause”. Perhaps you’ve heard of it. Then there’s the fact that these boneheads in blue let a wounded human being bleed out without, apparently, lifting a finger to help.

How about the cops call for emergency medical aid, or is that too much to ask? They’re the ones with the radios after all.

Dipstick.

Yeah all those gunshot and stabbies really need to take responsibility for their injuries. Not to mention those trouble making women who get raped.

The best way to deal with gunshot wounds seems to be to skip prehospital care and get the patient to the hospital asap.

Studies have shown that trauma victims thrown in the back of a car and rushed to the hospital have higher survival rates than the ones who arrive in an ambulance, and not because the severity of the trauma differs.

In Philadelphia these days, when the police arrive at a shooting scene they don’t wait for the paramedics, they throw the pt in the car and head for the nearest trauma center. Maybe they stop a spurting wound but that’s it.

"So why didn’t the kids call 911 for help instead?"

The last thing they should have done was put him in a car. They could have actually contributed to his death in doing so. Their first move should have been to call 911. Someone on the other end of the phone could have given them instructions on what to do until medics arrived. Sounds like these kids watch too much TV. Throwing a seriously wounded person in the back seat of a car and driving them to a hospital tends to be a regular theme in many programs.

Facts and fault can be figured out later.
Medical attention can’t.

Wait for $2,000 ambulance that takes 25 min...?

Ridiculous.

"For 14 straight months, the San Jose Fire Department has failed to meet a Santa Clara County standard to respond to at least 90 percent of emergencies within eight minutes. No other fire department in the county missed that mark for even one month since the targets took effect in 2011." -- Mercury News.

Calling 911 for real medical emergencies can be fatal
