More Workers Are Claiming ‘Wage Theft’(working for free)

MIRA LOMA, Calif. — Week after week, Guadalupe Rangel worked seven days straight, sometimes 11 hours a day, unloading dining room sets, trampolines, television stands and other imports from Asia that would soon be shipped to Walmart stores.

Even though he often clocked 70 hours a week at the Schneider warehouse here, he was never paid time-and-a-half overtime, he said. And now, having joined a lawsuit involving hundreds of warehouse workers, Mr. Rangel stands to receive more than $20,000 in back pay as part of a recent $21 million legal settlement with Schneider, a national trucking company.

It’s not just illegal aliens.

Last year, my employer cut my pay 20%, claiming “the IRS made us do it”.

I don’t work there anymore.

What? None of them get a pay stub? It’s laid right out, in detail, where your pay came from and where it goes.

This is exactly why the Chamber of Commerce is in favor of illegal immigration. There’s a lot of profit in getting illegals to work for free doing the jobs that Americans would want to be paid for.

70 hours is no joke, I do that at my law firm now and then (more last year than this year, but i have had my share of 15+ hour days this year).

If they didn’t pay me time and a half for hours 8-12, and double time for hours 13+, I’d just leave at 5:00pm.

Both sides have a point here.

Some companies I’ve worked with try to claim that workers meeting the definition of employees are “really” subcontractors. This is usually bogus and an attempt to skirt the law.

Many of the businesses that contract out janitorial and similar services take the low bid, being perfectly well aware that the price they’re paying is not enough to allow the company to meet legal requirements for paying its workers. It’s a “plausible deniability” thing. They pretend they don’t know what’s going on.

Obviously, every competitor is forced to follow suit or be forced out of business by having his price drastically undercut.

A similar situation applies, BTW, in businesses that sub work to companies that hire illegal workers.

Nothing new here it happened to me as a 17 yr old factory worker, I would routinely get 42hrs a week and only be paid for 39 hrs. If the line broke down we were off payroll until it came back up and could not leave. No air conditioning, minimum wage was $1.10 an hour.

This company probably belongs to the US Chamber of Crony Fascists and wants the door wide open for illegals.

I hope all such companies get devoured by the monster they created.

I worked as a salaried manager and for years not only worked well over sixty hours a week but also worked many hours in non management positions. Years after I left, my friend who continued to work there sued when he left for overtime hours not paid because of all the hours worked in non exempt positions. He won big, I was saddened that I was not aware at the time of my leaving or I would have sued for my wages owed for the same abuse.

As I recall, when president Eisenhower spoke out against illegal immigration one of his pillars was that employers are as culpable for abusing the system. He wanted both security against illegal intrusion, and penalties for employers who engage these workers, and who enable, and even promote the practice of illegal immigration for their own illicit gains.

Unfortunately, the nanny state LBJ you down need to work because the government will take care of you, great society, has replaced.abusive employers as the primary draw.

I agree we need to stop these employers from hiring illegals, but we also need to stop the government from providing a free check for those who get the free pass when they cross illegally. Both are now required to disincentive the incursion.

Build the dang wall!

My Great Uncle worked worked for Ford during the $5 an hour days as a millwright in the ‘20s. Everyone got docked when the line went down.

I worked 2 1/2 years, 6 days a week, daylight to dark with no overtime pay, insurance, workmans comp, vacation or holiday pay.

If you were hurt on the job you paid your own medical bills, and were fired until you were well enough to work again.

Travel time to and from the jobsites and lunch was unpaid, even though you had close to an hour of equipment loading time each morning before you left for the jobsites.

When work slowed in winter and you were off for several weeks you were SOL, no unemployment.

Since I had left home at 15 my job options were limited until I turned 18.

Today they would have buried that guy under the jail, but he got away with it back then.

Every week we work with a bunch of guys from a company called ESP. They work the same hours we do, but only get paid for 40, while we get paid time and a half for everything over 40. Not only do they get screwed out of their OT, they get paid a laughable 14.50 an hour handling explosives. That just isn’t right. Why do the employees suffer because the company way underbid the contract? When this contract was run by ANTECH, these guys made 19.25 an hour and got paid overtime. There is absolutely no excuse for this crap.
