Really couldn’t say. My guess those states that restricted eminent domain could be found in the South and Mid West. Those states on the left coast and the North East, probably not so much.

The legalization I was referring to was legalization of pot, which should take away the WOD link to civil forfeiture, but probably won’t. The appetite of corrupt officials who obtain funding through these seizures will remain, and they’ll find another excuse to continue this type of activity. For example, large amounts of cash have been seized by police under the presumption that they mus have come from illegal activity. Sometimes it’s true, sometimes it’s somebody going to an auction.

Kelo is legalization of seizure or a different sort. It lowers the bar for taking (although with compensation, a major difference) from public purpose to government-crony supported private purpose. It sucks, too, but I was using the word “legalization” in a different context.
