A Kansas foster father who mistakenly left a 10-month-old baby girl to die in his hot car has been charged with first-degree murder. Seth Jackson's lawyer said that the felony charge was far too strict for his client, who only remembered the baby was inside the car two hours later when something on TV jogged his memory.
'Rather high for a mistake,' attorney John Stang told NBC of the murder charge, which carries a life sentence with a minimum of 20 years in prison.
'I'm not trying to say it's not a horrible loss. The death of a child is an awful thing. But this person is looking at 15 more years than someone who was driving drunk and ran into a car and killed someone.'

I’ll give you 5 to 1 odds that his main motivation for fostering was to earn cash from the state to buy his next hit.

Parents should be able to put their babies in the front seat. Before airbags babies did not die in hot cars.
A foster child is just a government paycheck to a lot of people.No emotional attachment to the child.Or perhaps he was high at the time and just forgot.
Is that their wedding photo?
Is this the one that searched on-line for how long it would take the kid to die while the baby was suffering?
There will be outraged freepers who have no memory of the 50s, 60s and 70s chiming in that you don’t know what you’re talking about when it comes to car seats. Out of sight, out of mind. I don’t know the full story on this one, though.
Well fine, then you can charge negligent manslaughter. But first degree murder is a ridiculous. This doesn’t fit the perqs for the definition of the crime.
The "mistakenly" part is the opinion of the writer, despite her stating it as a fact.
If the jury decides it was unintentional, no matter how idiotic and reckless, then it won't be first-degree.
I can be as absent-minded as anybody. Recently spent 10 minutes looking for the pen behind my ear. But I simply cannot imagine "forgetting" about a baby in the car.
Would also like to point out that "safety" concerns have instructed parents to put the kids in the back seat. Pretty difficult to "forget" about the baby riding shotgun. I assume some at least of these incidents would have been prevented had the kid been in front.
But nobody ever considers that something done to prevent Risk A might increase Risk B. They just around and pat themselves on the back for reducing Risk B.

I’m assuming one day they will repeal these stupid laws. How many deaths it will take (including dogs!), I don’t know.
Of course, with two happily married gay men, who knows what went on with this.
AMEN! Every time I read an account of a tragedy like this I think the same thing! Nanny state government in an effort to protect babies from injury in a car accident created a situation where things like this could happen.
Yours is a good idea - then there will be NO excuse.
But I’m sure the Nanny State will come up with a reason why not.
