Family members of one of the teens charged in USC graduate student's death insist that he is innocent Two minors fought back tears during an emotional court hearing in downtown Los Angeles as they and two adults faced capital murder charges in the beating death of a USC graduate student.

Emotions ran high at Tuesday's hearing as relatives of the group of four, age 19 to 16, sat in the audience a row way from the friends of deceased student Xinran Ji.

The family of one of the defendants, 18-year-old Andrew Garcia, repeatedly told reporters that he is innocent and had left home that day to go to the beach

Garcia -- along with Jonathan DelCarmen, 19; Alberto Ochoa, 17; and Alejandra Guerrero, 16 -- each face one count of murder in connection with Ji's death.

Earlier news reports were that 5 people were involved: The 3 older males, the 16 year old "Alejandra" and a 14 year old female who isn't getting mentioned much.

This seems to be a definite case of cultural insensitivity aimed once again at our future American leaders, the latino community.

The Garcia, DelCarmen, Ochoa and Guerrero youths were merely carrying their bat to a piñata party when they encountered Chinese grad student Ji. Mr Ji may have misunderstood the reason for their bat and assumed a hostile posture; or perhaps Mr Ji made a disparaging remark about neck and head tatoos as he passed them in the street. Whatever.

I am certain that George Will, Glenn Beck and Jeb Bush will be able to set this straight. Surely it was just an ‘act of love’ gone terribly wrong.

Prosecutors have yet to decide whether to seek the death penalty against Garcia and DelCarmen. Ochoa and Guerrero are not subject to the death penalty because of their age, prosecutors said, and instead would face life in prison without the possibility of parole if convicted.

This is why I'm not living in LA/Santa Monica anymore; it was once the best place on earth. I wonder how many more of these criminals poured over our border today.
