Judge rules Boulder County lacked legal authority to create subdivision paving district

Formation of district and imposition of assessments 'invalidated' by ruling . Boulder County commissioners didn't have the legal authority to establish a Local Improvement District created to charge rural residential subdivision property owners the bulk of the costs of rehabilitating those subdivisions' paved county roads, according to a Friday Boulder County District Court ruling.

The Board of County Commissioners "exceeded its jurisdiction and abused its discretion in authorizing and forming the Subdivision Paving Local Improvement District and imposing assessments on properties within the District," Senior District Court Judge J. Robert Lowenbach wrote.

The judge further ordered Boulder County to "promptly return the assessments and/or installments collected, with interest, and remove any and all liens" imposed as part of the funding mechanism intended to help pay the costs of rehabilitating and reconstructing about 150 miles of paved roads in the county's unincorporated residential subdivisions over the coming 15 years.

What happened? Did some county assessor get whacked? Did the judge get a “promise?”

Frankly, good news as it is, is very atypical from what I perceive Boulder-anything to be.

Are we talking about Boulder, Colorado here?

This ruling was a GIANT F-you, F-you, F-out, two-handed one-finger salute by the Judge at the Boulder County Commissars.

(BTW, I was personally affected by the results of this lawsuit and contributed $500.00 to law firm hired by FIRM a few months ago. The $500.00 was roughly equal to one year’s illegal assessment on my property.)

Yes.

-2- Voters are supposed to approve all new taxes, new tax districts, and such. A county [ corrupt ? ] attorney should know that a county board must get voter approval first.

Hence the big government facists hate TABOR.

We’ve had several similar cases here in Lewis and Clark County Montana. The County forced the subdivisions to pay, they sued, the court found in their favor and assessed the county millions in fines and fees. Just the county trying to get out of paying for the roads they’re responsible for.

The big government lovers do not want to perform their basic jobs like roads and bridges. They think it is funny to steal our gas & diesel taxes set aside for roads & bridges, then divert them to their scams like bike trails, mass transit, welfare for criminal invader illegal aliens, and such.

Yeah, the ‘non-motorized transportation’ is the big push around here these days. Makes no sense to me, given how harsh and long our winters are. I really don’t see many people riding their bikes with a foot of snow and 25 below zero.

Yep. That’s the way it works here in Boulder County. The Commissars figure that mostly well-to-do (white) folk live in the 10,900 housing units in the county subdivisions, and of course these are the very people they spend most of their time trying to shaft in the first place.

We’ve had two special elections for this that the Commissars placed on the ballot in the past three years, both of which were rejected at least 3 to 2. The second and most recent special election gave voters two choices plus NO; the two choices were “BAD” and “WORST THAN BAD”. The Commissars also publicly announced that they would proceed with the illegal “improvement” district on their own if the “NO” option prevailed, which it did. They then placed 10,900 leans on properties overnight with no notice, and as it turns out by the time we figured out what was going on, there were only 4 days left to file a lawsuit, and the only way one could be a plaintiff was if the person payed the ENTIRE 15 year assessment up front before the 4 days ran out! Ya just gotta love the way Kommies operate.
