Vindication in the Tea Party Case against IRS
breitbart.com ^ | 7/17/14 | Mark Meckler

Posted on 07/18/2014 6:06:17 AM PDT by cotton1706

As evidence of IRS wrongdoing mounts, it’s great to get some good news. Today, U.S. District Judge Susan Dlott rejected the IRS’s motion to dismiss the NorCal Tea Party’s class action lawsuit.

The government had the audacity to claim that citizens have no right to redress against their own government, regardless of the behavior of the IRS. The judge disagreed, stating that not only could the case go forward, but also setting up a status conference date, indicating that the case will not simply languish on the docket.

In other words, folks, the IRS is going to have to answer for its illegal conduct.

Beginning shortly after the tea party’s emergence in 2009, the IRS has been harassing and giving extra scrutiny to tea party, pro-Israel, and patriotic groups. This governmental intimidation was orchestrated by senior IRS officials and facilitated by the White House, congressional Democrats, and a cooperative mainstream media perfectly willing to look the other way.

In fact, that’s been one of my biggest disappointments. Liberals who presumably love freedom and dislike government oppression blatantly ignored what the Obama administration has done to these tea party groups, simply because the targets weren’t the right kind of people. I can only imagine the strong reaction of reporters and Democrats (oh, but I repeat myself) if this had happened to liberal groups under George W. Bush.

The IRS wrongdoing has become a Rorschach test for all Americans. Some look at and see the government agency’s admission of illegal harassment as intolerable and abhorrent – an assault on some of us, which is also an attack on all of us. Others, blinded by their own partisanship, believe there must be more to the story, in spite of the government’s own admissions.

Judge Dlott allowed our lawsuit to move forward with claims for declaratory and injunctive relief, as well as our key claim under Section 6103 of the Internal Revenue Code.

What is the key claim... 6103?

The author is sadly misinformed.

If I were part of this lawsuit, I’d be asking my lawyer to investigate how to sue IRS employees involved in this PERSONALLY. Revenge, retribution and reclamation of this country’s belief in the integrity of its agencies. Sue each one for money they could never hope to repay and then garnish their incomes forever.

and return information.

This is cold comfort. The outrageous abuse of power worked. The IRS hampered the Tea Party groups so that they could not impact the elections. If one or two people go to jail now, it would not make up for this abuse. Only if we gut the IRS and rebuild it, or go to a very simple flat tax, will we stop it.

6103 seems to refer to a level of secrecy that prohibits the IRS from divulging anything about tax clients records/status. Apparently the IRS violated their own code - probably numerous times - with NorCal Tea Party being a case in point.

Obama is ‘getting to the bottom’ of the IRS issue by having the IRS go all-out in court to keep its activities secret.

If the GOP would have a candidate, any candidate, who would run on promising to dismantle the IRS and go to a flat tax, that person would wn in a heartbeat. The IRS is the government’s single most coercive and intrusive agency. And don’t forget, it’s in charge of Obamacare, too.

Well, in Hayek’s definition of “liberal”, certainly.

But, it’s no wonder that an ideology based on Satanism would take a perfectly good word and apply it to an oppressive, destructive, murderous worldview.

If the House had any guts,
they’d completely defund the IRS until they cooperated,
and start jailing people in the mean time.

ABOLISH the IRS.

The government should never ever be allowed to abuse this power again.

I don't think it's blind partisanship. I think it's greed and thirst for power to impose your will on others that allows people to overlook the tyranny.
These others don't want liberty and justice for "all".

Liberals who presumably love freedom and dislike government oppression

Liberals don't care about freedom, and they take malicious pride in government oppression - of others.

Others... believe there must be more to the story...

They believe no such thing. Their reprobate, anti-Christ nature creates a double standard in which they justify lying, cheating, stealing, maligning, abuse of authority, collusion, intimidation, and eventually murder to win. (But only for them against their opponents. If the roles were reversed they would be the first to appeal to the better nature of those with Christian values for relief).

Their moral compass is so perverted, and they are so driven by self-interest, that they become incensed like a small child when they do not get their way. Like that small child, who has not yet been taught right from wrong, they desire to hurt those who prevent them from getting what they want.
