EPA pulls back from plan to garnish paychecks

The Environmental Protection Agency bowed to fierce criticism Wednesday and announced that it had hit the breaks on a fast-tracked plan to collect fines by garnishing paychecks of accused polluters.

The agency, which has come under withering attacks from Republican lawmakers for attempting a “power grab,” said it still intended to pursue the new authority to garnish wages without a court order. But now it will follow a more typical and longer review process.

It's prolly one of them-there Metro-riding beltway types that don't own a car whats never heard of and wouldn't understand the technical workings of a brake.

Imagine it being on a par with not knowing the price of a gallon of milk and/or feeling the need to go to MinnesOta to find a commoner with whom to share some time.

I admit that I'm not up to speed on how the EPA came to acquire this "new authority."

Did they just deem it unto themselves and then wait for someone to push back and oppose it, or do they think that Congress delegated the authority to the EPA in some bill?

Good. Does this mean I may continue to dig holes in my gravel driveway, to dispose of motor drain oil, without fear that my Social Security check will be taken away?

That driveway is going to be asphalt pretty soon....

Lenin said that when dealing with an enemy, stick a bayonet into him. If you hit bone, pull out and stick it in somewhere else. If you meet no resistance, keep pushing.

This is EXACTLY what the statists do on a regular basis - they try a bunch of things that wouldn't be tolerated if actually debated, but there are so many that most get through without anyone paying attention. Occassionally, they get too ballsy, get caught and have to retract their plans a bit. This clearly doesn't happen often enough, but at least we clipped their wings a bit this time.

The EPA is claiming this authority through the Debt Collection Improvement Act of 1996, which apparently gives all federal agencies the power to conduct administrative wage garnishment, provided that the agency allows for hearings at which debtors can challenge the amount or the terms of a repayment schedule.

I assume that this Debt Collection Improvement Act was intended to address consumer debt delinquencies?

It was not intended to allow a federal agency to create a crushing and punishing fine or penalty, and then use the Debt Collection Improvement Act to seize the cash directly?
