CNN Reporter to Carney: Does Obama ‘Feel as Though He’s Above the Law?’

After questions about the legality of the White House sidestepping a law requiring Congress be given thirty day approval notice for a prisoner swap, CNN chief Washington correspondent Joe Johns asked outgoing White House Press Secretary Jay Carney if President Barack Obama “feel[s] as though, on this issue and this kind of issue, he’s above the law.”

“Absolutely not,” Carney replied. “We have repeatedly noted concerns with this requirement. In signing statements, [Obama] has consistently made clear that the executive branch must have the flexibility to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers if necessary, and that was certainly the case here.”

Johns also asked if Obama’s deployment of signing statements was in line with his original view as candidate that restraint is called for in their use.

I wish we could get a SCOTUS ruling on signing statements. every single President has done them ... and a LOT of them ...and we have no definitive ruling. I’ve never researched it even though I have done a lot of Constitutional litigation but it sure seems unconstitutional to me.

It’s not as easy as saying “above the law” because if “signing statements” ARE Constitutional then the POTUS (any of them) is well within his legal authority.

I just can’t stand them. We need a ruling.

It's been posted here in another thread.

Almost exactly a year ago, Carney expressly stated that Obama would follow the law and consult with Congress before trading Taliban prisoners for Bergdahl.

The terms were proposed by the Taliban long ago. Suddenly, the Obama administration decides to accept them, and is in such a hurry they can't notify Congress. I wonder what changed?

Still think all the reporters except for CNN and MSNBC should vacate the premises during these worthless briefings until legitimate questioning is permitted by a free, not collaborative, press. Folks would get tired of that very soon.

Problem with that line of thought is that when you put that meme out there, it reverberates.

"Does Obama feels as though he is above the law?"

becomes

"Obama feels as though he is above the law."

It's like the apocryphal story about LBJ who accused his opponent of animal sodomy. His Chief of Staff said, "Sir! We have no evidence of this AT ALL!" and LBJ just smiled, and said, "I know. I just want to hear him deny he's a pig f***r."
