It seems I’m roundly misunderstood here. I said “whatever the case”, meaning even if this person wasn’t resisting arrest, it’s never a good idea to anyway.
You are correct. It is like the words “Racists” or “territorial imperative” or “homophobe” . They mean what the user wants them to mean. They were coined as political correct terms.
I understood what you meant but I still beg to differ. There will come a time when resistance is critical to the continuation of our Republic.
If the “deputy” in question is part of a “union”, the county had better do LOTS OF HOMEWORK to insure they have a “bullet proof” case. If there is the slightest chink in their armor the deputy will walk away with LOTS OF MONEY. This has happened over and over here in Wisconsin and you can take if from someone with lots of experience with cases like this, the deputy will have to be bought off to go away. The county will not want to take the issue to court and it will be much easier (meaning less expensive) to pay off the deputy than to go into litigation. It happens all the time.

Uh, he was charged with resisting arrest. The same photos that nailed the sadistic SOB cop also show he was not resisting arrest at the time he was being choked. The resisting arrest charge is after the fact ass covering by the department.
If the arresting officer is going to beat, choke, rape or murder you once you are cuffed, I'd say its a fantastic idea to resist arrest. What's the downside, to fighting him off and surrendering later via your lawyer? Jail time for resisting arrest is preferable to the other options.
Fortunately, this time was caught on camera and he's now former Officer Phillips.
