Yes it’s quite true the law as written right now does not allow the IRS to take any action, punitive or otherwise to recapture lost monies associated with non-compliance with Obamacare (for those who are not due a refund). However two things:

1. As we (here on FR) are well aware, future sessions of Congress are not beholden to any law past sessions have passed. How long do you think it will be until that particular subsection you cited will be quietly changed in some midnight session before a Christmas, Thanksgiving or other major holiday? That will of course go unreported? Not too long. Probably after 2016, if not 2014.

2. Forget about even going through the inconvenience of rewriting the law and passing it legally, when this shortcoming becomes to great to ignore, Obama will simply whip out his pen and rewrite it himself via an executive Order.

Factoryrat is right. The seizure of liquid assets and property is coming, if nothing changes. You can count on it.

So here’s my question, Roberts ruled that mandate survived as a tax. Is it within the President’s power to excuse tax debt or just untax the people. Is it within anyone’s power except Congress?

Sometime in the far future that could happen when once again the uninsured are portrayed as freeloaders raising costs for the rest, but no chance of that happening anytime soon, Dems wont even mention that mandate.

That wouldn't work in this case. Its one thing for him to not enforce the mandate (calling it a delay), but its another for him to impose penalties that are clearly forbidden by law.

The IRS wouldn't have a chance on that in court.

So after all the nonsense, ACA simply has become a big expansion of medicaid for democrat voters, and a Government rigged insurance market that helps crony insurance companies for the rest of us.

The excerpts of the PPACA do not say that a better collection method could not be introduced. For example, why go after tax payers individually when you could simply put their employers on the hook for the unpaid tax/penalty/premium. How many of us W2 employees write a check to the government to pay for Social Security? Right, it’s just withdrawn from your paycheck automatically by your employer. Don’t worry about the IRS putting you in jail or issuing a lien, it’s much more efficient to simply “deduct” funds from your paycheck, or more surreptitiously, make your employer liable for doing it on the Government’s behalf. Not only is that coming, it’s already here.

That law was written specifically as a employer collected payroll deduction, this one was not. The employer can just not do it.

At least this regime is honest about one thing - they aren’t hiding who they’ve determined the enemy is -

They’re gonna do a ‘dry run’ test up in Alaska. Remember, what with all the muzzie advisors in the WH and on the board of Homeland Sec - “Islamic Terrorists” is not allowed on the list of ‘terrorist suspects’ and the muzzie training camps around the country are being ignored - but Christians, Constitutionalists, Tea Partiers, and Returning Vets ARE on the list.

(This all ties in with the purge this year of so many of our top brass - those who wouldn’t go against their Constitutional Oath and sign “The Pledge” to obey the orders of the traitor in chief if he gave the command to fire on Americans - have been ousted. Suely, we live in perilous times. Question: Will they declare M. law before the elections - i.e. total takeover
