UAW Asks NLRB to Void Union Loss at Tennessee Volkswagen Plant

The United Auto Workers (UAW) filed a legal challenge late Friday with the National Labor Relations Board (NLRB) to the certification of the organizing vote it lost last Friday at Volkswagen's auto plant in Chattanooga, Tennessee. The challenge was submitted just hours before the seven day post-election filing deadline expired.

On Tuesday, attorney Joseph Farelli, a nationally recognized labor law expert, told Breitbart News the UAW would have little chance of success if it filed a challenge to NLRB certification of the election. "I don't think the NLRB is willing to break new ground and state the conduct of a third party is sufficient to void the outcome of the election."

As Farelli explained, labor law on the grounds for filing a challenge to an NLRB certification of an organizing election is very clear.

The clarity of the law has never stopped Obama's people from doing what they want. I'm worried.

And whining, kicking and screaming because you lost is not sufficient grounds.

However, given the Left leaning makeup of the NLRB, I would not be surprised if they did what the UAW is asking.

I have a question. Let’s say the Obama loaded MLRB finds some obscure reason to overturn the election. I am assuming they cannot award victory to the Union but can only order a new election. My question(s)are:

1. Is there recourse to stop this from happening (revote) and if so how is it done? Does it go to a local Court and begin it’s journey to higher courts on each appeal by the Union if they lose?

2. In a secret ballot I am assuming the ballots are not including the voters name. If true how does the Union hope to change votes? How would they even begin to know who to go to in order to change their vote?

The outcome is already determined.

The Holderdork will make sure of that.

The only recourse is to not buy VWs...which, given their low reliability, makes them ideal UAW products anyway.

To bad, because they are good machines...when they work.

Yes I do. Do you think the NLRB can actually order how the votes would be cast?

What about my other question about an appeal to the decision of the NLRB should they call for another vote?

The UAW is emboldened due to all of Obama’s crimes. The time is ripe for them. I hate unions but have to admit that I belong to one. I work at a closed shop and have no other choice.

I arrived at my first job just after a unionization effort where people against the union had their car’s paint destroyed and lost (in some cases) so many sets of tires they were forced to quit. Apparently what happened was employees in favor either did the deeds themselves or reported the non-union talk to union thugs.

You can bet if there’s a re-vote the union will send in its muscle.
