Virginia’s marriage amendment declared unconstitutional

A federal district court judge has ruled that Virginia’s marriage amendment, which defines marriage as the union of one man and one woman, is unconstitutional.

Voters approved the measure by a 57%-43% margin in a 2006 referendum.

“The court is compelled to conclude that Virginia's Marriage Laws unconstitutionally deny Virginia's gay and lesbian citizens the fundamental freedom to choose to marry,” said Judge Arenda L. Wright Allen, whom President Barack Obama appointed to the bench.

“Government interests in perpetuating traditions, shielding state matters from federal interference, and favoring one model of parenting over others must yield to this country's cherished protections that ensure the exercise of the private choices of the individual citizen regarding love and family,” she added.

In recent weeks, the state’s bishops lamented the decision of Virginia’s new attorney general not to defend the marriage amendment in court.

Just how, precisely does this trump the 10th Amendment?

We are rapidly approaching the point where state laws and constitutions are replaced by rulings from black robed thugs.

He should be removed from the bench - one way or the other. This is outrageous - legislating from the bench which makes him a criminal, not a judge.

Bunk. The People have a right to define the society they live in and "government" is supposed to implement that.

Nothing but the twisted rationalization of a deviant to overturn the lawful Will of the People.

If the Founders had thought for one second that their words could be used this way to legitimize homosexuality they would have made Marriage the First Article in the Constitution this fraud claims to know.

It's not a "he".

She's a third rate lawyer from a couple of obscure schools spouting clap trap that she's told to repeat.

In other words, an Obama appointee.

"Judge" Wright

Federal courts have no jurisdiction over state laws.

I can choose to marry a man. A lesbo can choose to marry a man. I can choose to remain single. Lez can do the same. Neither of us can choose to marry a dog or a tree or a rock. Where’s the inequality?

The Founders were pretty specific adamant about spelling out the powers that fedgov was to be limited to. That's what article 1,section 8 was about. "Hey, here's what the federal government is allowed to do. Period!" And to help drive the point home even further, the did a "No, short-bus people...we really, really mean that article 1 stuff!" when they wrote the 10th amendment. But then somebody thought it would be a good idea to take stolen money and do favors for married people. That's where fedgov got the power to redefine your religious institution for you. You answer isn't to try to put people in power who will keep doing favors for you. You need to tell uncle sam to keep his damned favors and get out.

You and I think alike.

Makes no freaking sense.... either society CAN define marriage? Or, we can't.

That’s Wright, she’s wrong!

Those Americans who believe in freedom, the Bill of Rights, the kind of Republic the Enlightenment Thinking of the Founding Fathers created, western civilization, and the Judaeo-Christian morality from whence all the foregoing springs, had better take stock of themselves and start working harder to protect that.

The statist left wingers here reject ALL of the foregoing, want to flood this country with illegal immigrants, pander to Muslims, cater to sodomites, destroy our economy with nonsensical environmental tripe, create a one-world economy, and relegate America’s foreign policy to that of a strategic nonentity.

They have seized control of the Courts, the colleges, the schools and even many main stream Christian churches.

Either we go under or we fight back and either way its not going to be pretty. At least with the latter alternative we have a chance.

They weren’t denied. They had the freedom to marry.

It’s time for Virginia to remember the state motto —Sic Semper Tyrannis or Thus Always to Tyrants — and rise up in revolt against the Marxists, Fascists and other tyrants that have taken over the state and America.

BTW, the Great Seal of Virginia has a warrior dressed as an ancient Roman standing atop a dead man he has just killed in the name of Liberty.

I hope the Supreme Court takes this up as soon as possible, because if this stands then Missouri’s amendment and every other amendment passed by the other states goes out the window.

Umm, "they" being the Founders of this nation ever since the Articles of Confederation. Stay ignorant misguided libertarian; the fact is that marriage has been recognized by various secular central systems throughout the ages.

One of these days, they’re just going to have to declare Virginia itself unconstitutional. Bu WV is already unconstitutional, for VA never approved of its creation, as required by the Constitution.

The inequality is in that you should be allowed to marry a dog or a rock. Demand your constitutional rights to marry whatever you want to marry.

I’m being sarcastic, but the North American Man Boy Love Association will be using the ‘gay marriage’ issue to legalize their perversion and how much behind will be those who want to legalize what is currently known as beastiality?

VA is one of many states sorely lacking in constitutionalists.
