Supreme Court Puts Gay Marriage On Hold In Utah

The Supreme Court has put gay marriage on hold in Utah. The high court on Monday granted the state a stay in their same-sex marriage challenge. The decision comes after a federal judge last month ruled in favor of gay marriage.

There are several reasons, depending on how far into leftist ideology one wants to venture, but one of the most common drivers is unspoken,,,, just follow the money . . . getting company or government “benefits”. Using the law to impose societal acceptance is another.

No, Sotomayor didn't grant the stay on her own. She could have denied the stay on her own, but she chose to refer the stay request to the whole court. If she had denied the stay request, Utah would have had the right to submit it to a second justice of their choice per standard SCOTUS procedure. Utah would have chosen Scalia or Thomas. Either could, and likely would, have granted the stay or referred it to the whole court as Sotomayor did. Sotomayor just circumvented that second stay request because she knew it was inevitable and simply referred it to the whole court herself rather than make Utah go through the legal motions. IMHO, this is not indicative of her position in any way and is not a surprise. LL may or may not have more to offer by way of legal procedure, etc.

What you wrote is correct. Every request for a stay goes first to the Justice assigned to that Circuit; if that Justice denies a stay, a party can, in theory, keep asking one Justice after another until they've asked all 9.

In practice, every time a request is made to a second Justice-- and almost every first request in a high-profile or controversial case-- the Justice who gets the request will ask the full court to decide it (as Sotomayor did here). That is simply to save time, because in those situations it's clear that multiple requests are going to be made.

What I do think is significant is that there was no recorded dissent from the grant of a stay in this case.

I was even thinking on a more base level. How could a guy be sexually attracted to another guy? It's just strange to me, but I guess it happens. You are correct though. You can almost always follow the money, and yes now we have moved from not only "societal acceptance" but to almost a type of "forced celebration" of this stuff. It's not good enough now to simply "accept" we must also "celebrate and praise" the behavior lest we be labeled all types of terrible names by the tolerant left.

Agreed. Regardless, it is happening YET any debate on the facts and merits regarding the issue has yet to happen in any court of law I am aware of.

The propaganda of the homosexual agenda has been so successful that 'progress' seems a forgone inevitability. The legal house of cards is premised upon propaganda accepted as gospel fact & slight of hand that replaces procreation with the emotion of love as the declared rational underlying society's institution of marriage. The courts accept as fact that there is a 'gay species' and with no rational basis that society must be imposed upon to confer upon 'married' homosexual sex partners the same social blessings it has freely conferred upon married heterosexual sex partners.

Last I checked Utah wasn’t allowed to become a state unless they outlawed polygamy.

Why?

Marriage is what it ALWAYS has been 'defined'.

Do tell? Is it common to see such dissents or is it that you expected ideological lines to be drawn this early with respect to a stay request for same-sex marriage?
