Federal Judge: Mt. Soledad Cross Must Come Down

A cross atop Mount Soledad in California is an unconstitutional religious display on government land and must come down, a federal judge in San Diego ruled late Thursday.

U.S. District Judge Larry Burns ordered the cross, which honors veterans, must be removed within 90 days -- a decision that could result in the case being sent back to the U.S. Supreme Court. Burns immediately stayed his order pending an expected appeal.

Amen. We have runaway leftist courts due to the 17th Amendment. Absolute practical unaccountability.

I hope Ted Cruz gets aboard the Article V movement. In a daydream of mine, he does a Patrick Henry of 1765 on our corrupted senate.

It saddens me that our jewish friends are offended by the cross. Would be nice if maybe a Star of David could have been erected to represent their dead but a lot of Christian boys died fighting to free the jews.

The “Bush Appointee” ruled the cross was constitutional. It is the Ninth circuit that reversed that ruling. The U.S. Supreme Court declined to hear the case last year, but said it could reconsider once a lower court enters a final judgment.

Burns ordered the cross to be removed then stayed that order until all appeals have been exhausted.

Both sides consider this a victory. Cross supporters say this ruling moves them closer to getting the case reviewed once and for all by the Supreme Court.

“I’m somewhat upbeat about this. Believe me, we’ve had darker days,” said one of the opposing lawyers, Charles LiMandri, president and chief counsel of Freedom of Conscience Defense Fund.

Well, sounds like the first shot across the bow of patriots.......

So how many of those chest thumping rambos are now willing to step forward and rally around that cross?

I know, I know, soccer practice this weekend, working overtime at the job to pay the mortgage and note on the new truck and boat..........maybe in the spring.

When the cross comes down, it will not be gone, for it shall stand forever as a monumental testament to the infinite intolerance and ultimate smallness of those who are bothered by its’ presence and celebrate its’ removal.

So in other words, the system is so entrenched in its anti-Christianity that no one can stop it or reverse it. We got precisely what the Founding Fathers wanted to avoid: a system fully unaccountable to the American people.

why would he have immediately stayed his decision without a request by the plaintiff to do so?

Fro the same reason an engineer on a runaway train can still flash lights and toot the whistle.

There are convincing posts on this thread that show that it is not the judge who is to blame but the system of laws he cannot bypass or overturn. Which is a far worse scenario than a liberal judge doing whatever the hell his ideology dictates.
