Zimmerman could still be held responsible for Martin's death

But a court could still hold him accountable for the death.

Two options, however, are available: A civil suit, or a civil rights suit.

The NAACP is pushing the U.S. Department of Justice to file a civil rights suit.

The Rev. Jesse Jackson told CNN's "New Day" on Sunday that his Rainbow PUSH Coalition also wants the Justice Department to look into possible civil rights violations in the case.

In the meantime, the FruitLoopers over at MSNBC are trying to figure out how to change jury selection rules because the TrayTrial jury was so racist.

“Common sense” changes though...nothing too dramatic.

I don’t think a civil lawsuit is going to go anywhere. The family has already collected a settlement from the insurance company for the homeowners’ association. This probably means the insurance company has effectively acknowledged that Zimmerman was acting on behalf of the association and is therefore protected by whatever personal indemnification provisions are written into the association’s bylaws and/or Florida law.

There was a segment on this story on NPR last week, and they had two guests on who were covering the story in Florida for a couple of magazines or newspapers. The guests were very much slanted in favor of a conviction, and they didn't hide their bias.

A guy who claimed to be a retired police detective called the show and sharply criticized the guests for their bias. He also said something remarkable: He said everyone involved in the case on the side of the prosecution wants it to go away quickly, and that they know there is no way in hell Zimmerman is ever going to be convicted. He said these people all raised holy hell against Zimmerman when they thought he was of German and/or Jewish extraction, and that they realized they made a huge mistake when he turned out to be a Hispanic of South American descent.

“Peter Johnson Jr., Fox’s legal guy, say that the Justice Department could bring charges against Zim, and that he could conceivably get the death penalty.’

They must be delusional or worse.

I think double jeopardy would kick in if they tried to bring another criminal suit and for civil suits they can only impose monetary damages — at least that’s how I understand it.

I do hope Zimmerman goes after NBC for their willful and malicious reporting. His ability to produce income not to mention his safety have been ruined for the rest of his life. NBC needs to pay.

Does George Zimmerman NOT have equal “civil rights”? Martin attacked Zimmerman. WHo’s civil rights were violated at that point> I do not see where there is any difference other than the ultimate outcome.

Martin is and was responsible for his own death.

Can a private citizen violate another private citizen’s civil rights? That seems like something only the government could do.

The attorneys on Fox were talking about this. All of them except one (black, of course) agreed that it would be a waste of time for the Feds to try to pursue civil rights charges. There are only two possible options. One would be a charge of deprivation of civil rights under color of authority. That would require that Zimmerman was an employee or agent of the government at some level (think Rodney King case).

The second option is a hate crime charge. However, that would require the feds to prove either A) a pattern of behavior over time that demonstrated hatred toward blacks; or B) a specific act or set of acts associated with this case that demonstrated that Zimmerman pursued and shot Martin because he hated him because he was black. Now, if they had that kind of evidence, the would have used it in the state case to try to prove Murder 2.

Of course, that doesn't mean they won't try to charge him just to make him spend time and money defending himself from bogus charges, just as the did in the state case. Hopefully, his winnings from his cases against NBC, ABC and CNN will give him enough money to cover those legal expenses as well.

Zimmerman is obviously “responsible” for trayvon’s death. It was his gun and bullet. So what? He did society & civilization a big favor. Maybe nobama will give Zimmerman the Medal of Freedom.

It is my understanding that under Florida law when self-defense is claimed and the defendant is found not guilty, civil claims are not allowed.

That's not correct. Florida Statutes, 776.036: "A person who uses force as permitted in s. 776.012, s. 776.013, or s. 776.031 is justified in using such force and is immune from criminal prosecution and civil action for the use of such force..." In order to be immune under this you have to claim self defense and have your case reviewed by a legal panel. If that panel agrees that it was indeed self defense then that makes the person safe from either prosecution or civil actions. Zimmerman waived his rights to the panel and he was prosecuted. The fact that he was found not guilt may help in defending against any wrongful death suits but it doesn't prevent someone from filing them.

There were quite a few Klan convictions in the 60's that found out a private citizen can.

As a rule, a civl rights action requires state action or color of authority, but given this DOJ and liberal judges, don’t be surprised if the law is judicially rewritten.

According to Johnson, double jeopardy would not apply. But I’m with you....I just cannot imagine such a thing happening in this country. I’ve never heard of any exceptions to double jeopardy.

Excuse the unintended pun, but surely Zimmerman has enough ammunition to take large portions of the media and political classes to the cleaners for the things they have said about him, let alone the kids family for damages.

Justice will not be served until Zimmerman is a very rich man and rightly so.
