Confiscated Cell Phone Footage of Beating Death Released...

Cell phone footage that was confiscated after the police beating death of a Bakersfield man was released this week, not showing much as far as the beating goes, but capturing David Silva’s horrific screams during the last moments of his life.

However, footage from the second phone that was confiscated that was more incriminating, showing the actual swinging of the batons, was apparently deleted.

And according to an attorney, it doesn’t look as if even the FBI has the capability to recover it because of the type of phone it is (check out video below for details).

Here is some of what attorney Rodriguez said about the above video:

“They don’t have a search warrant and they demand the phones,” he said. “And this thing of ‘freezing the crime scene,’ we have to remind everybody, this was not the crime scene. The crime scene was over at the hospital, so this freezing of the residence is illegal, is unconstitutional.

“They’re not the criminals. They had nothing to do with the crime, if in fact, a crime was committed. If you’ve not committed a crime and because you’re a witness, that does not allow you to be detained and be held against your will. That’s not the way the law works. You have the right to come and go as you please.

“Now if you’re suspected of committing a crime, it’s a whole different ballgame. If there’s probable cause, then police have the right to detain you.

“But here, they have the right to videotape. That is not a crime. They have an absolute Constitutional right to do that and they have an absolute Constitutional right to disseminate it, to publish it, to put it on Youtube, to put it on Facebook.”

One thing that hasn’t been mentioned is the body-mounted audio recordings and dash cam footage from the two CHP officers who were also at the scene, which will no doubt provide more evidence against the officers.

Police deny the report, saying it was heart disease that killed Silva.

And why exactly is OJ in Jail in Vegas??? As far as i am concerned, every last person involved, including the Sheriff himself is GUILTY OF MURDER, under the Felony Murder Rule they are all as guilty as the jack booted thugs that beat this poor man to death. THEY ALL BELONG IN PRISON FOR LIFE. Remember folks the Police ARE NOT YOUR FRIENDS and they NEVER WILL BE, they are Agents of Tyranny and deserve to be treated as such.

UPDATE: Questionable autopsy performed by Kern County Coroner – who reports to the Kern County Sheriff – determined that Silva died of heart disease, not from the beating.
Reminds me of the assistant coroner dying unexpectedly after the coroner said that Breitbart died from natural causes.

Police came into a home and shot an out of control unarmed man yesterday instead of subduing him. Said that was procedure.

Something big has changed in the past 5 years of policeing. Something has changed to allow killing for all issues.

That’s not the way the law works. You have the right to come and go as you please.

That IS the way the law works. It is not how it is supposed to work. When we reach a point that an officer only has to say, "I felt threatened," and any killing by him is justified then the law is dead- the Rule of Law is dead.

The ‘perp’ made a 'furtive' movement is the phrase they use. We are all ‘perps’. Too bad, it did not used to be this way, but somewhere it became ‘us against them’, and the thin blue line circles the wagon when one of their own commits a crime.

They conk an unarmed man ON THE HEAD and the coroner says heart attack. I hope the jury is skeptical to the max and looks for every answer.

Okay, so how crazy (or drugged up) was the dead guy? Normal people don’t scream like that just for being arrested. Notwithstanding that, conking a subdued individual on the head is a no-no.

Bullshit...the guy had .9 blood alcohol in system along with drugs,meth and painkillers. A sheriff deputy found him face down on the grass. He attacked the deputy when he awoke....he was hit with batons, but no strikes were done to the head or neck. His heart disease and obesity did him in...

Toxicology tests showed Silva had amphetamines and methamphetamines in his system and a blood alcohol level of 0.095%, the sheriff said.

I have the same info, you do. And it still *all* stinks to high heaven. E.g., where is the dashcam video? And what does it shoe?

Careful now sheana, you will upset the cop haters. The coroner’s report was that the guy was not struck on the head, he had BOTH meth and oxycodone in his system and his blood alcohol was .09. He most likely died of respiratory failure due to the meth in his system.
