Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

At least she’s being honest, rather than saying she doesn’t recall. She’s tacitly admiting [sic] guilt.

Pleading the 5th is not a tacit admittance of guilt just like using your 2nd amendment rights isn't a tacit admittance of being a troublemaker.

I don’t see any reason to do any victory laps about this. She is probably still on Team Kenya and this is the game plan they gave her. Delay, obstruct, delay, misdirect, delay, etc.

The question I just get back to is, what is the GOP going to do about this scandal? It’s not enough to have some hearing and bloviate. There needs to be some sort of offensive action. Removing the IRS from Obamacare would be a good one for starters.

Lawyers from Wilmer Cutler Pickering Hale and Dorr have won the dismissal of an IRS case against United Church of Christ, Sen. Barack Obama’s denomination.

The IRS initiated an investigation early this year after a speech by Obama at a 50th anniversary celebration of the church last June. It was a reference by Obama to his presidential candidacy in a talk otherwise focused on faith that caught the agency’s attention.

Obama has been a member of Trinity United Church of Christ in Chicago — a UCC congregation — for more than 20 years. The church has been in the headlines for several months now as the congregation lead by the controversial Reverend Jeremiah Wright.

WilmerHale was retained after church officials interviewed several firms, according to partner William Wilkins. “We were so interested in the case we offered to do it pro bono,” Wilkins says.

Poor woman is caught between a rock and a hard spot. There’s probably lots of paper and other docs that can fry her, but she can’t flip on who gave the orders because they were verbal.

Good. It means we’re close.

First, call for her to be fired. A federal employee that refuses to answer honestly to Congress is absolutely not someone you want around. Obama will look stupid keeping her in a position of authority.

Second, Bring her up to the Hill and make her plead the fifth for 3 straight days. Make a mockery of her. IMAGINE the harm she did to her fellow citizens!

Third, start looking into who is going to be the Special Prosecutor and let that nugget start getting around town.

Last, start letting it be known that whistle blowers will get all the promotions and protections available.

Can’t the House Committee grant her immunity from criminal prosecution and compel her to answer questions?

But they won’t be able to prevent someone from the administration from killing her which may be her real fear.
