I read somewhere today that the older brothers 2009 charges were dismissed and that prior to permanent legal status just being charged was enough for deportation but after permanent legal status a conviction was required. IIRC he was given permanent legal status c. 2007. I don't know how much of that is accurate; I just saw it reported.

However, if it were me in charge I'd take a different tact. His mom has been charged with shoplifting $1624 worth of clothes from a different branch of the store whose video id'd her sons. She hasn't gone to trial yet. Yet she was defending her sons by phone today... from Dagestan! Why was she allowed to leave the country? Does anyone think she'll voluntarily return for that trial now? I'd up her ante with felony charges for fleeing prosecution, plus anything else they can allege, then ring Putin directly to have her extradited back here pronto. Putin may not like us, but he hates the Chechens and is smart enough to see his advantage in helping this time. Hold her without bail, as a flight risk, in a Boston jail. Then talk to young bomber...

Who cares if he gives a statement or not. Seriously. Give him all the rights he needs because the case against him is about as solid a case you could conceive of. When he is convicted and is waiting on death row led him flounder around in the Aryan brotherhood wing of some prison where he can be their little girl and beg for mercy or more whatever his inclination might be.

Reportedly he naturalized last 9-11 so he can't be an enemy combatant. But as a US citizen he could be a traitor. "Treason against the United States shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort," says the Constitution. Darn few treason convictions in US history, yet I'm not surprised to see FR has someone experienced in such. Kudos for helping nail your bastard! Based on your experience, what would you think of adding treason to his list of charges?

As an aside I feel Miranda rights have been taken too far, but I'm not aware of any exemption from them for unconvicted traitors. Once convicted I'd give traitors everything allowed when the 8th was ratified.

If the police are going to question someone in custody, then the Miranda rights must be read.

No, they don't. There was a Supreme Court ruling on this a couple years back, can't remember the case. But so long as the police and prosecutors don't try to use whatever the suspect says to indict and try, they don't have to Mirandise.

It's useful in cases where it's key to get quick information/intelligence out of a suspect.

In this situation they have the punk dead to rights on being the 2nd bomber. There's video, pictures, all sorts of additional forensics tying him to both the bombing and being in the shootout Thursday night/Friday morning. He's going to get convicted regardless of what he says or doesn't say. Hopefully he'll ride the needle, just like McVeigh did. But with this Administration I have my doubts. A better alternative would be to just strip him of his US Citizenship and hand him over to Putin for a little justice, Russian-style.

There's absolutely no need to Mirandize him. Better to put as much pressure as legally possible to get him to spill information on potential accomplices, funding, training and the like.

U.S. citizen arrested on U.S. soil had better get due process.

I dunno, I wondered from the go how come Delta wasn't on scene. This was an act of terrorism; an act of war. I do not see how Posse Commutatis(sp) comes into effect, or how this is a law enforcement issue.

I'll modify and extend my remarks:

If someone is in custody, and the police want to present his statements as evidence at trial, they must Mirandize. You are correct in that evidence obtained which is not the result of a Mirandized statement can be used to convict. It happens all the time where a suspect clams up, but there is enough to convict anyway.

They clearly DID have connections in the Chechen terrorist world. According to the latest article on WaPo:

‘Also Friday, the FBI confirmed that its agents in Boston had interviewed Tamerlan Tsarnaev in 2011 at the request of a foreign government. A law enforcement official said the request came from the Russian government, concerned about Tsarnaev’s potential ties to Chechen terrorists. But, after that interview, the FBI did not follow him further, officials said.’

Actually that is good. I would have preferred the effer be dead, but if they are treating him as a terrorist, WHICH HE IS, that’s good news.
