N.Y. Assembly Speaker Silver: ‘We Are Going To Ban Assault Weapons’

ALBANY (CBSNewYork) – The New York State Legislature was poised Monday night to pass the first gun control measure following the Newtown school massacre. This as the vice president was set to unveil federal proposals to end gun violence on Tuesday.

Albany lawmakers have reportedly ironed out the kinks, allowing them to enact new gun control measures in the wake of the Sandy Hook Elementary School mass shooting. Assuming the new bill passes — it was sent to both house of the Legislature on Monday night — it will turn into the toughest set of gun control laws in the country. ...

The new state legislation will:

* Limit ammunition clips to seven. It’s now 10

* Force gun owners to renew their licenses every five years

* Stiffen penalties for using a gun in the commission of a crime

* Stiffen penalties for bringing a gun on school property

* New restrictions on the assault weapons already owned by New Yorkers

“They will be basically not permitted to be transferred. They will be grandfathered in but not in terms of a transfer. There will be a registry,” Silver said.

huge number of legal gun owners in NY State will now be criminals. They can’t use the gun because there are no 7 round clips

I read the bill and New Yawkers get to say bye bye to their M1 Garands and the requisite en blanc "clips".

It always helps to have made a good argument. When you do so, you weaken the resolve of your opponent, even if you lose the overall debate.

If they ever do ban and then attempt to confiscate, God forbid, I assume there will be resistance. At that point, it is crucial that those who resist have logically, calmly and coolly made the case already.

Thanks for the link. Some here are dismissing New York as deserving this, but it is just the start. We need to join our fellow patriots in New York and get this law changed. I'm sure a lot of New Yorkers didn't even have a clue that this was happening.

Obama is using the same tactics as Hitler. He goes after one group, then another, then another... until no one is left, but disarmed dispirited citizens

Obama doesn't need to use an executive order.
State by state, he's accomplishing what he wants with the help of his friends.

I've just seen that the politicians in Trenton New Jersey are up to no good too.

I hear you. I hope everyone here will be supportive of those who resist this destruction of our freedoms. Those who fight this head on will have way more courage than any keyboard warriors. Will we wish them God speed, or call them terrorists?

You can say the same thing about letting Obama have four more years. If the people of the United States allow Obama to win our presidency, then they no longer deserve to be free.

New York is part of this Republic. We all need to join in this fight. This is a fight for all the citizens. Our Constitution is being attacked.

Those of us who live upstate can only do so much when there is a huge cancerous mass of Obama parasites and gun haters in NYC. That is who controls the legislature. And in NY all we have are RINO Repubs anyway.

The one thing I didnt see in this bill is a 7 round magazine restriction which was widely reported in the local media.

Using a state to pass the first big anti gun legislation was actually brilliant. While we were all busy fighting and talking about the Federal anti-2nd amendment bills, New York Democrats with the help of RINO Republicans are pushing through an anti-2nd and anti-4th amendment bill.

Divide and conquer. This is not meant to be a New York bashing thread, but a thread for ideas and to spread the word.

If anyone knows TeaParties in New York that will help get the word out, please post the information. How about the gun organizations? What are they going to do?

What is the best way to get this in the courts?
We need 2nd-amendment attorneys to help us?
We need the populace to wake up.
It is happening. Our rights are being stolen from us.

You apparently think everyone in NY is in lockstep with the lefties. You have no clue. there are vast areas of this state that are more “redneck” than “y’all”.

You are absolutely right. A lead pipe is an assault weapon so I guess we should ban all plumbing supplies. While we're at it, screwdrivers, hammers, nail guns, stapplers and letter openers should also be banned. Hey I got it, let's all move back into caves and start all freekin over! When is the nightmare going to end?

McCulloch v. Maryland

My memory is a little hazy on it, but I thought it was the Supreme Court case that established the Constitution as the supreme law of the land and that states couldn't usurp it with their own internal laws.

According to Wikipedia, I was almost right: "state action may not impede valid constitutional exercises of power by the Federal government." Of course, this decision seems to skirt the 10th Amendment, so...

Maybe I'm thinking of another SCOTUS case?

It’s time for Remington to take move their manufacturing plant and 1100 jobs out of New York to a state that actually respects the 2nd Amendment. The hypocrites in Albany don’t mind making and exporting guns to other states, while denying their own citizens the same right.
