Brewster, N.Y. – 1/13/2013 – Today Senator Greg Ball (Patterson – R, C, I) announced that a burglary has been reported on Davis Ave. in White Plains, New York that evidently ties into The Journal News gun maps. It is reported that the burglar used The Journal News’ interactive gun map to target a home included on the map. Luckily the gun was locked up and no one was hurt.

Actually, the list is of pistol permit holders, not those homes protected by legally held but unlisted long guns. Any (many) of the unlisted homes are protected by a 12 ga or other firearms.
Normally, I’d agree. But in this case, having him still around to testify is actually better - the homeowner can now use his testimony to end up owning the Journal.
Publish the addresses of the newspaper staff and remind people that it is likely that cash, jewelry, and other valuable are likely present in these homes and that the owners are likely to be unarmed.

Yep it’s to the left of the marker. Google maps will give you directions and the fastest route to the house.......in case they invite you over for a party or to just hang out and chat. Cause that’s why I’d like to know where someone lives.

Where is the info on the burglary suspect? They must have him if they already know how/why he picked the location.
Recourse against the National Journal is slow in coming. Not a peep that what they have done is practically home invasion on their part, giving out keys to homes. NY and eastern state politicians are mostly silent and this alone is shocking.

As much as I wish it were different, there is no way under the current interpretation of the First Amendment, to win a lawsuit against the newspaper. The press is given enormous leeway to behave stupidly.
In this case, the information was a public record and the newspaper published it. As reckless and stupid as it was, there wasn’t anything illegal about it. Yes, it was immoral, and inherently stupid. Yes, it was done with the malicious intent of maligning gun owners. However, the fact remains that newspapers are allowed to publish public records, no matter the negative consequences that might flow from their foolish decisions.
People think “sue” is a magic term that immediately brings showers of money along with unicorns and rainbows. That isn’t true. There has to be a valid ground for a lawsuit. Any lawsuit against the paper wouldn’t survive a motion to dismiss. The issue is with the New York law that requires handgun permits in the first place, and then makes that information a public record.
This may have actionable consequences if the plaintiffs appeal to the area of tort law called intentional tort. This is the legal theory that covers any deliberate interference with a legally recognized interest, such as the right to keep and bear arms. Other things such as the rights to bodily integrity, emotional tranquility, dominion over property, seclusion from public scrutiny, and freedom from confinement or deception would qualify. It is true that any jury would have to balance this against First Amendment issues, but applying a “reasonable person” standard, the “seclusion from public scrutiny” might carry some weight. The firearm owner is not a public figure, so the “absence of malice” defense would not apply. Remember that a unanimous vote of the jury is not required in tort cases.
I’d suggest taking a look at Cox Broadcasting v. Cohen, 420 U.S. 469 (1975).
The paper is run by slime bags. No more no less.
That being said, the problem is not that a state document should be open to public display. That is a given that it should.
The problem is that the state sees fit to usurp the US Constitution and regulate a stated Constitutional FREEDOM, and spy on its citizens possession of firearms.

I believe many more retired and active duty police live in Putnam County where officials have stood up and said they will not disclose. I’m proud of them.
