Texas NDAA Nullification Bill Includes Criminal Charges for Federal Agents

At the close of 2011, Barack Obama signed the National Defense Authorization Act for the year 2012. In it are what some constitutional experts consider to be some of the greatest constitutional violations in American history. At issue are sections 1021 and 1022 which, in essence, create a new power for the federal government to “indefinitely detain” – without due process – any person. Indefinitely. That’s little different than kidnapping.

In response, there’s been a bit of a firestorm from people across the political spectrum. Local communities in Colorado sent out the first warning shots, passing resolutions and ordinances rejecting such power earlier this year. Then, at the close of the 2012 state legislative session, Virginia Governor Bob McDonnell signed House Bill 1160, making that state the first to paw a law not only rejecting the federal act, but fully banning any state agency from cooperating with the feds on it.

Currently, more than 15 local communities have done the same. Michigan is also considering a bill that is similar to Virginia’s. And today, Texas State Representative Lyle Larson introduced House Bill 149 (HB149), the Texas Liberty Preservation Act. This might be the strongest anti-NDAA bill introduced yet.

It states, in part:

Sections 1021 and 1022 of the National Defense Authorization Act for Fiscal Year 2012 (Pub. L. No. 112-81) violate portions of federal law, the United States Constitution, and the Texas Constitution and, as such, are invalid and illegal in this state.

It also, like Virginia’s law, requires full noncompliance with the federal act:

It is the policy of this state to refuse to provide material support for or to participate in any way with the implementation within this state of Sections 1021 and 1022 of the National Defense Authorization Act for Fiscal Year 2012

So a federal agent can come in and take someone into custody without due process, etc, be in the process of driving that individual out of state (kidnapping) and only face misdemeanor charges??

Sounds like 20 years to me.

BTW, if the agent was successful in getting the individual across the state line, would Texas pursue and seek pursuit, arrest and extrodition for the agent from other states?

It is the real beggining of the push back. an armed revolt will not work. people are mad but are not yet ready to give up their lives for that of an armed revolutionary. The revolt will be real but not with arms. The ballot box will not work as we have just seen from this past election. I truly do not trust any democrat in a position of authority when it comes to voting (other issues also but not part of this discussion).

After the Bush/Gore issue in Florida, George Soros got a group of his like minded billionaires together. This included the owner of Phoenix University and others that I do not recall offhand (age). Their conclusion was that they needed to focus much of their election efforts on the each states on the office of whomever is resposible for certifiying the election (Secry of State) as well as the local election officials. It has been quite effective.

It is time for revolution

I see that you are not familiar with our County Sheriffs. They are not to be trifled with especially if you are a Fed.

Thanks AAC! I like it, but I have this sinking feeling that this may be too little, too late. Hacking at the branches of a very large tree so to speak. This administration has GOT to be removed by the roots. Useful idiots along with what I suspect was massive voter fraud has just about done us in. Surviving another four years of the jug eared kenyan will be a major challenge. Revolutions have begun on less provocation.

Let’s be honest, if it was Bush doing this, many freepers would be making excuses for it. I remember all sorts of violations of civil liberties put into place by Bush that conservatives defended. I remember thinking “yeah, cuz you trust Bush not to abuse it, but someday we’ll have a president who *wants* to abuse it.”

The only way this could stop them is if the bill were to authorize full use of deadly force against perps by all citizens.

Many in the public are calling this a call to start a new country based on nothing or anarchy. It must be made clear that all we are asking for is a TRUE Return to the Constitutional Principals that Founded the original 13 States.

JMHO, but I think what's clear is there are elements in this country that could care less. Many of them in this administration, including dear leader, and certainly a majority of the Dim party. Fact is, Constitutional principles are a roadblock to their agenda. Our would-be masters have been snipping around the edges for over 200 years and the jug eared kenyan is making the final push. All the while we set on our collective butts and screech about it. Organized resistance is the only thing that will put a stop to the madness. Where's OUR community organizer???

IMHO, it's likely a simple matter to organize deadbeats, miscreants and other assorted malcontents but organizing a group of conservatives whose primary goals in life are to care for their families and be left alone is a horse of another color. Our "enemy" knows this about us and they will continue to push until they are met with enough force to exact painful consequences. Will it happen? Beats me. BUT if it doesn't, our children and grandchildren will end up slaves on the government/corporate plantation.
