Judge denies Allen West motion in Palm Beach County

Judge [Jim] Crow denies Allen West's motion in Palm Beach County. He says West motion is "premature" since no the election has no official results yet; also says the legislature, not courts, sets election procedures.

A Palm Beach County circuit court hearing on Republican U.S. Rep. Allen West’s motion to impound ballots and voting machines is scheduled for noon today.[snip] West filed a similar motion in St. Lucie County.

I don’t know if this is true or not. My son said that he heard or read that the military vote was not counted. That a huge majority of their votes, from key swing states were delivered to the wrong locations and arrived the day after the election. That the number of ballots would have possibly swung the vote to Romney’s side. Anyone else heard this?

manc, wasn’t it a republican legislature in FLA that erased West’s original district in the first place? If I am wrong, please don’t hesitate to kick my butt, but I seem to recall questioning WHY at the time.

Exactly! Which is why the process is closely observed by representatives of both parties. They do the same thing with ballots that are damaged, filled out with crayon, or have marks and drawings on them in addition to the votes. Most Counties try very hard to ascertain what the intent of the voter was (example: ballot rejected as an “overvote” but visual examination shows the voter marked space for XX and also wrote XX in the space for write in candidates. Clearly they meant their vote to count for XX- so it would count.)
As of right now- nearly 5pm on Friday November 9- the initial counting is not completed.
1- Provisional ballots had 3 days to show proof they were eligible to vote- that is today. So not all of them have been added in for every county.
2- Military absentee votes have to be accepted in the mail through the weekend (I believe) as long as the vote was actually dated prior to election day. So they wont be counted for several days.
Once all the votes have been counted, each County reports their results to the Secretary of State. Margins of less than .5% trigger an automatic machine recount. If margin remain that close, a manual recount of the over and under votes is done by the canvassing board.
Once the results have been certified, there is a process for a candidate to contest the outcome- which is why the judge told Cong West his request is premature.
He needs a good election lawyer- he could have a cause of action, but right now it's hard to tell.

I also read that there were huge problems getting military ballots delivered- including a mail plane crash in Iraq or somewhere.
The laws in each state are different- I believe in some northern states, absentee ballots are not counted unless they could change the outcome of a race.
Florida is under a Federal Consent Decree to accept and count military ballots received for a period of time (I think it’s a week) after election day, so most counties hold them and count them all at one time.
We count all ballots every election, but with nearly 9 million votes, it takes a while.

Yes, all the Districts were redrawn by a Republican dominated legislature in Florida last year. But the voters had overwhelmingly passed a Constitutional Amendment the previous election requiring Districts to be compact and keep communities together. It was a difficult exercise, which had to be approved by the state Supreme Court.
Because we added 3 new Congressional Districts due to population growth, there were major changes to nearly every one of the Districts.
Many incumbents ended up in new districts with another incumbent, so there was some scrambling right before qualifying to change where they were running. West and Rooney ended up in the same District- Rooney moved and won.

Those three arch-liberal Florida state Supremes just easily won retention to their seats on Tuesday's ballots. Just damn!

It's difficult to unseat any judges by retention amendments because 95% of the electorate just votes "yes" because they don't have the foggiest notion who the judges are and if they're liberal or conservative or registered sex offenders.

This is why I voted no on all amendments except the first no matter how "heart-wrenching" they appeared to be.

I'm against amendments in principle. The issues should be legislated in Tallahassee after debate in the open......and judges should be on the ballots by party every four years.

Cases like Col. West's today are prime examples of how we have to take back the courts. Right now the liberals control the judiciary and will control even more after Obama gets done appointing.

Yes they have not given all their results in yet.
yep they do this every frigging time, they wait for all counties to report and ten they give their numbers knwing how many they need.

This time military and absentee ave not been counted and so those counties , yes those Dem corrupt counties have not given their numbers and will not do so until the absentee and military have been counted and added to the state numbers

This is what we are up against, corruption and the grand ole party said we move on , nothing to see here.

course as their elitist power seats are safe they don;t care about us.

I had ot go down there a few times for boxing, in St Lucie, West Palm beach , Hollywood etc and I hated it, .
it felt that I was in the liberal northeast with the way they drove and don;t get me started on their lack of manners, their arrogance.

they moved down here and then think FL owes them something.

I don;t understand why they move south and then try and make their new states look like the dump they left.

For the record I have lved up north and my wife is form there and she fitted in here right away and is now an adopted southern gal

What is the issue with Palm beach? How come they cannot get an election done with all of this BS? Is it the voting process or are the people simply stupid? So many town in the country can get this stuff done in hours...and count them again in a couple of days. Is there someone out there that can explain it to us?
The deal is that this little part of Palm Beach is run by dems who like to cheat . They can't get them counted (BTW here you vote on a paper ballot and enter it into a machine that automatically counts everything ) because they have to change and manufacture them to get the results they want . The entire problem in this is area is corruption and the fact that they allow people to vote by mail (don't have to show id like when voting in person) .


Allen West was targeted for redistricting because of who he is - a real American who loves this country and an Evangelical Christian who loves Israel - the GOP elite does not like him because they don't own him and the dems hate him for who he is . They moved his district so he would have a lot more dems in it and the most corrupt ones in the county to boot (you can thank the Rino Republicans who redrew this district for that one ) Not all of Palm Beach county is like this - it's a big county
