If CFA's lease states they have the right of first refusal, it would be illegal. And most commercial leases have that right.

I am afraid I am a little spacey. Could you elaborate?

Briefly, when your lease is expiring your landlord has to ask you if you want to renew. If you do, the lease is renewed with possible modifications.

If you leased a store in a mall and had made an investment in your “presence” there, wouldn’t you want that protected at lease renewal time?
