Clearly, it was jolting news the New Mexico Legislature's Water and Natural Resources Committee wasn't prepared for. During Monday's committee meeting, in the Barbara Hubbard Room at the Pan American Center Annex, lawyers representing the New Mexico Office of the State Engineer, Elephant Butte Irrigation District, and the city of Las Cruces, told the committee that a state Water Court hearing will be at 9 a.m. Wednesday, at the Third Judicial Court Complex, 201 E. Picacho Ave., and the future management of state's water supply could hang in the balance of the hearing's outcome.
"Why hasn't this been front-page news?" asked a surprised Clinton D. Harden Jr., a state senator from Clovis. "This is one of the biggest things ever. Frankly, what we're looking at is under the camel's nose. This is an unprecedented legal claim to water."

Just today my “republican” governor announced that he was spending $38 million on various “wildlands” projects in my area of Michigan including buying a 2000 acre tract a few miles from me and a skate park in Ann Arbor.
Wildlands projects? I remember Michigan having thousands of acres of wild lands.

When a governor does something similiar to what Michigan’s is doing, it really shouldn’t be that alarming, as he is more accountable to the citizens of your state. You can recall the POS!
What the Federal government is doing, plainly is unconstitutional. The Western governors must get their acts together and run riot over BHO2. They have the power to do that and I would hope they do it soon.
Only four more months to go, folks, until November. Obama knows his time in the White House is drawing to an end and he is going to pull more of this same crap in an effort to push Americans to the breaking point.

I’ve seen your post, and I don’t disagree with you. I could never be a Democrat because after Kennedy/Johnson, things started to go very strange. George McGoven basically kidnapped an already seriously flawed party, and took it down to new depths of depravity, UnAmerican Activities to the max. Kerry was doing his part about then. Clinton and Obama have both done the party one better, leading it to a place that is as vile as anything we have seen around the world over the last 100 years.
I say this, on the offside chance that some folks will wake up to what is going on, before we do see a U. S. Lenin, Stalin, or Hitler. That is exactly where we are headed.

In this case in NM, not just Republicans upset. Dem legislators, especially in northern NM, represent Hispanics who have surface water rights for irrigation using centuries old ditches (acequias). This threatens them also:

I hope the democrats in the State leglsator are paying attention, If new Mexico loses this is an absolute disaster for the entire state on the level of a crisis.
You cannot underscore this point the People of New Mexico cannot survive without water! Water is THE most valuable resource in the State. If Washington is allowed to take control of New Mexico’s water they will control & dehydrate the state.
This fact should be taken as a certainty because New Mexico’s neighbors hold far more sway over the Federal government than does New Mexico. They are simply bigger and more numerous.
State Democrats are going to pay dearly if they can’t convince Obama to back down, and leave the state alone.
For several years now, these thieves have been telling us, through fear-mongering about water shortages, that they’re coming after our water.

Canada and the Great Lakes states came to an agreement that the feds cannot drain the Great Lakes to send the water somewhere else. Congress approved it. King Barack will ignore it and grab that water, also.

It's the same all over the West: If you control the water, you control the land.
It holds true whether the use of that land is ranching, mining, agriculture, or just people living.
It also crosses my mind that New Mexico has an oil and gas industry, too, and this may be a preemptive strike to prevent the sort of hydraulic fracturing essential to development of many resources there as well as elsewhere.
States like North Dakota are geared up to fight any such attempts, but New Mexico not only might not be, it might have enough liberals to sympathize and help set a dangerous precedent for Federal Control which could be applied elsewhere.

I submit that this is by design, and that the goal is to get the urban ratio up to about 95%.
Thanks. I track their activities as best I can. I keep an eye on local “Smart Growth” organizations. The U.S. Fish & Wildlife Service seems joined at the hip with U.N. Agenda 21 plans. Need development in an area stopped? No problem. The USFWS will find an endangered bug, bird or microbe that will bleed the developer dry with endless litigation.
That really is how it starts isn’t it. The Feds will pick on a state that is either hated or poorly disposed to defend itself then uses its easy victory there to squelch other states out of their rights.
It is a fight for our rights we were as they intended never predisposed to win. Their hand picked court is by design & selection rigged against us. What is remarkable is that we are in fact able to win some of the time. But of course that is never enough over the long run because we only really have to lose once.

This is the work of Secretary of Interior Ken Salazar and Secretary of Agriculture Tom Vilsack. In a letter to them from the Western Governors Association:
The ramifications of such legal position extend to the very heart of the Western states exclusive ownership and/or management and control of the groundwater resources within their respective boundaries.
Jay Stein, a lawyer representing the city of Las Cruces, who has filed as an intervener in the case, said the outcome of the hearing could potentially affect the citys water supply.
In the pending water rights adjudication in state district court, here in Las Cruces, the court has turned to the United States claims. Foremost among these is the issue of the United States claims to groundwater or to project water in the ground, as they have termed it.
These claims are not supported by any actual beneficial use of groundwater. Nor are they supported by state law which governs proceedings in the adjudication.
These water claims are unqualified but potentially could amount to hundreds of thousands of acre-feet per year.
