Oregon Man Sentenced to 30 Days in Jail -- for Collecting Rainwater on His Property

A rural Oregon man was sentenced Wednesday to 30 days in jail and over $1,500 in fines because he had three reservoirs on his property to collect and use rainwater.

Gary Harrington of Eagle Point, Ore., says he plans to appeal his conviction in Jackson County (Ore.) Circuit Court on nine misdemeanor charges under a 1925 law for having what state water managers called “three illegal reservoirs” on his property – and for filling the reservoirs with rainwater and snow runoff.

But sentenced to 30 days in jail for collecting rain water is justified?

This is not his first offense...he was already on probation and opened up the gates the first time. He then reclosed the gates again whole under court order not to do so..

I suspect this has been going on for a while and did not just come out of the blue.

There is probably a lot to this story we don't know.

Some people have a very high tolerance for what they will be fined and incarcerated for doing - on their own private property.

This is not clear cut at all.

It appears that this is the case. He may have constructed dams on streams that ran THROUGH his property and not entirely ON his property.

Water rights are far more complicated than that.

You don't have 3 large reservoirs due to rainfall.

I would bet there was streams that ran through his property that he damned up and the neighbors lost their source of water or their supply was vastly diminished.

as the article said this law was in place since 1925 and this was the first time it was enforced.

Doesn’t matter if it were a 1000 years ago, CA would still get the blame for any states problems.

CA is the only state that has liberals, makes liberals, trains liberals, etc.

Then we send those liberals to other states for the sole purpose of polluting them with liberal ideas.

It couldn’t possibly be that the CA liberals came here from other states and are simply returning to their place of origin after $hitting in their bed here.

These CNS News articles are ridiculous. This guy is a repeat offender and has been on probation for his actions before.

The guy build dams to divert watershed water for his own use. That’s a little bit different than “collecting rainwater runoff” isn’t it? Sure, it’s a clever way of phrasing what he was actually doing, but you can’t argue that there should be some illegality to damming up streams willy nilly. This guy does it, his neighbor does it, his neighbor’s neighbor does it and then what?

Seems like a sane law to me and seems like this guy was repeatedly breaking that law. Go to jail.

My son wanted to buy a lot and build in Pagosa Springs, Colorado, for a future retirement home. Since we are from Texas, and do things differently down here, the realtor wisely suggested that we take a look at the restrictions before making a final decision. For almost two hours he read and talked non-stop, most of his sentences beginning with “You’re not going to believe this...” Didn’t take him long to decide not to build there or anywhere else in Colorado.

This is the second thread in a row whereby you made comments that are intended to belittle people fighting against government.

Here is the reality you should face: government at all levels is growing and consuming our wealth and destroying our Liberties.

Sadistic humans that infest the government bureaucracies spend the lives creating rules and regulations that are intended to destroy the human spirit.

Everything government touches it destroys -- education, housing, energy, our currency etc. The pension costs for government employees at the local, state and Federal level will alone destroy our future unless severely cut back.

Our Founders rightfully viewed government as a necessary EVIL. The did not look on it as a inherent "good."

Always??? Insulting. Have you ever dealt with an arrogant inspector, or with the proliferation of useless government forms? You have no idea the web of control those in government are wrapping around us.

The way of life Americans have enjoyed for generations is being diminished directly and intentionally by actions of power-hungry parasites in government.

Always? You have shown yourself one who worships at the Alter of State Power. No one who cherishes Liberty would ever say always In many of these reported cases there may be "the other side" but there are many more situations where there is sadistic abuse of citizens by those in government.

Don’t know about this law in particular, but more than one man was SHOT for disobeying water rights etc in the past. In places where water is pleantiful this seems silly, but if you are downstream from someone in an arid environment and they damn higher than thay should on the stream, your life and livelihood are at stake.

I’ll reserve judgement until I know further what exactly is going on.

I think the creator of rain would disagree with these dipships...If they own the water falling from the sky, they must also own the tornados, hurricains and hail....such a destructive government needs to be changed. yesterday.

The first thread was about the little boy not allowed to sell hot dogs on the city street. The blog post totally took that story out of context. The city had NO PROBLEM with him selling his hot dogs on the streets just not in that location...No other vendors where allowed to sell there either but the blog story made it appear they were picking on some little boy.

Nope don't work for gov't..actually want very limited gov't.

I grew up on a farm and saw first hand how neighbors can screw other neighbors..so yes it's not always as it appears and there is in many cases another side of the story

The rate of flow in the stream is the rate of flow in the stream. A dam would only temporarily disrupt it, then the flow would resume.
