A rural Oregon man was sentenced Wednesday to 30 days in jail and over $1,500 in fines because he had three reservoirs on his property to collect and use rainwater.
Gary Harrington of Eagle Point, Ore., says he plans to appeal his conviction in Jackson County (Ore.) Circuit Court on nine misdemeanor charges under a 1925 law for having what state water managers called “three illegal reservoirs” on his property – and for filling the reservoirs with rainwater and snow runoff.

The real tragedy is not that the law exists. There are all sorts of old goofy laws on books. In some states or towns it is STILL illegal to drive a car through town without someone walking in front of you with a red lantern warning people of your approach.
The tragedy is that some numbskull actually enforced it.
If you are storing runoff upstream, that means that a property owner down stream is not getting water, or not getting enough. I don’t see this law as unreasonable, since it is an attempt to balance the needs of all property owners within the watershed area. Nothing promotes animosity among neighboring landowners like a fight over water.
This is the type of conviction that the jury system was designed to prevent. Just a simple “Not Guilty!” should have remedied this whole situation.

Makes me think of the King county sheriff’s office in Maple valley. A few years back someone got into their enclosed parking lot and slashed the tires on all the cop cars.

I believe there is an water rights agreement with Kansas that rain is to fall unhindered so the run off can be used for Kansas agriculture.
I found that this is why you can still buy large acre tracts of land cheap in Colorado because there is no water rights there.
Essentially, without permission from the masters, all one can do to or on one’s property is pay the taxes on it.
There is always another side of the story and you just pointed this out.
That is the problem with these blog post you only hear one side of the story...and as Rush always say's it's not what they tell you but what they DON'T tell you that is more important.
OH, yeah....the same CITIES whose City PLANNERS design communities of primarily CONCRETE, cramming small lots together to build houses on, then TAX us because the water runs onto the streets...

OK. The point is well taken.
But sentenced to 30 days in jail for collecting rain water is justified?
And what does God say about this silly Oregon law?
Once the smoke clears and people see the wreckage, it will become obvious that the only way out of this mess is to round up liberals for imprisonment or deportation.
California liberals moved into Oregon many years ago.
