This confuses me. Roberts said it’s a tax. The republicans are out yelling “This is a tax!” If it’s a tax does congress not have the authority to levy it? If it’s not a tax then the republicans are idiots.

It is not as if Roberts has not done anything, then all of a sudden conservatives completely ‘turned on him’ without any reason.

There was a cause, which this judge conveniently ignored. He should square out the first step before condemning the others.

So, criticism from the right will also cause Roberts to become a liberal according to Judge Posner?

A week ago it was the fear of criticism from the left that cause him to turn liberal.

This rule: No matter the source of the criticism, Judge Roberts turns liberal.

The moral of the story: Roberts will go lib in the big decisions.

Not so simple. Congress does not have the same plenary taxing authority of a parliament. At least the language of the constitution does not allow them to tax anything and everything. Calling what the acts calls a penalty a “tax,” is a novel use of the term. If the Court takes what Roberts as precedent,it has great expanded the taxing power.

For example: Past pro bono work, pics of good times past with his current co-professor on Malta (wife and kids at home).

Well, the good judge should join the ‘sane’ Occupoopers.
These guys are liberals and they want both parties to be liberal. Tough.

One party will be for constitutional freedom and Western culture and ethics and free market economy and the other will be Marxist. These ELITIST limo-liberal globalist prisses can KMA. They are going to be harassed and run out on a rail if they are liberals screwing conservatives and our goals in the Republican party.

I agree that what showed was his, i.e. Roberts, liberal thinking. However, I also believe that he was given a nudge/suggestion based on something the public is not to know. He should have been given more vetting but apparently the nomination by Bush was taken to mean a conservative was being offered.

This pantload Posner must have taken the brown LSD. All of a sudden, Judge, we found out that the person we thought was our friend is instead a traitorous coward who shot America in the head and then scurried off to a foreign country on "vacation". How hard is this to figure out?
