(Reuters) - The U.S. Justice Department said on Friday it would not prosecute Attorney General Eric Holder for refusing to turn over to Congress documents about a gun-running scandal to Mexico.
Holder, who heads the Justice Department, was cited on Thursday for contempt of Congress by the Republican-led House of Representatives. The mostly partisan vote of 255-67 marked the first time a sitting attorney general and presidential cabinet member was cited for contempt by the full House. More than 100 Democrats walked out in protest and refused to vote.
In a letter to House Speaker John Boehner, Holder's deputy said that the attorney general properly withheld the documents under "executive privilege," which allows President Barack Obama to keep private documents on internal government discussions.
"The department will not bring the Congressional contempt citation before a grand jury or take any other action to prosecute the attorney general," said Deputy Attorney General James Cole.

There is a legal case from the 1800s where the Postmaster General refused to do something Congress ordered, saying that he was appointed by the Executive and didn’t have to. The case went against the Postmaster. Authority is delegated from Congress. The Executive only executes/imple,ments the law. The Executive cannot change it and do his own thing.
Here, the Executive appointee is at issue, so the delegation on execution of the order passes from Congress to the Deputy. He has to do what Congres says because it is from them that authority is delegated under the Constution. It is not from the President.
Hold the next lower level Justice official in contempt too then. And then the next one, and the next one, until one finally prosecutes, or there aren’t any left. Either way, it would be a Good Thing.
Eric witHolder is a political monster and does not work for the American people, merely the DNC. It’s Janet Reno all over again, only with a mustache this time. All of the gun grabbers are sociopaths and craven murderers that chase phantom militias of patriotic Americans.
The greatest injustices are those committed under the guise of “the law” and other than Obama, NOBODY sickens me more than our lawless AG.
