Gonzales: Maybe Roberts will punt today

Could this morning’s big decision be the biggest let-down since Geraldo Rivera broke into Al Capone’s vault on national TV? The man who vetted John Roberts for the nomination to the Supreme Court told CNN yesterday that he expects the Chief Justice to decide the case on “the most narrow grounds possible,” which means Roberts may well urge the court to punt on ObamaCare for now … and put us all through this again in a few years after the mandate has taken effect:

A major reason that the private economy is in the tank is because of this unsettled business surrounding national healthcare. Kicking the can down the road might make sense to the court from a legal standpoint, but it practially guarantees a worsening in the economic climate.

Except that the Chief Justice does not decide the case. He is only one vote.

Agree.

Roberts won’t be the first Supreme appointed by a GOP POTUS that turned into a squishy lib contracting Stockholm Syndrome by associating with the libs on the court.

We will see in the next 30 minutes.

This is the decision I expect. Everyone will be standing around scratching their asses trying to figure out what it means after the decision is announced.

I don’t believe Roberts will punt. That would not mesh with the division of cases doled out on the court. Roberts is reading the zer0care opinion, and has not read any other cases in the past few months. Hard to imagine he’d break off so large a piece of law to read, and then say all his (him and his clerks) effort was now just to punt.

No, the question is who will be siding with his majority opinion. Either it will be Thomas/Scalia/Alito/fence-sitter or it will be zero0-cheerleader/wise-latino/old-hag/fence-sitter.

Gonzalez was worthless, just like Holder, a crony to the president. Ashcroft actually cared about the law and did a good job. Gonzalez was political and inept. And from what I remember, Mukasey was relatively decent.

Doubtful, very doubtful. The rapidity of this cases march to the SCOTUS and the special extended time allowed for argumentation indicates a willingness to make a decision, not to “punt.”

If Roberts or the remainder of the Justices had been inclined to do this, why bother to grant cert? They could easily declined to accept the case and allowed the lower court ruling to stand.

BTW the SCOTUS just ruled that outlawing the fraudulent wearing of a CMOH is unconstitutional.
