Would you not agree this is a strictly constitutional decision? In other words, Justice Roberts agreed that it’s outside the reach of the Commerce Clause but not outside Congress’s constitutionally-granted power to tax?

If the word "tax" is not in the bill, how can the Supreme Court deem a fee a tax--a tax which forces you to buy a product as a condition of your liberty? That is unprecedented.

You can tax an activity or an item you posses, but you cannot use a tax to force commerce, and then take away a person's libert as a means to force that commerce.

I don't know how you reconcile the mandate does not work under the commerce clause and then say the taxing power can be used to create commerce.

This is complete bullsh!t.

You mean that SAME Mitt Romney that passed Romneycare in Massachusetts? I’ll pass. A RINO is a RINO and can’t be trusted. He can campaign on repeal all he wants. I don’t believe a word of it...

With that said, shame on you Judge Roberts for expanding the role of the ever-growing Federal government.

No, Ronald Reagan and GWB have preserved Obamacare through their own appointees!

6-3 overall, but he saved the mandate. Kennedy is actually reading the dissent.

If it's a tax, it can be repealed -- by the House. Overturn it today.

If it's a tax, it can be regulated -- by the House. Starve the beast today.

Defund it. Screw the hospitals and the doctors who back this monstrosity.

10:15 Tom: Chief Justice Roberts' vote saved the ACA.

And when the sun sets:

9 Tammuz

Jerusalem Walls Breached (423 BCE)

The Babylonian armies of King Nebuchadnezzar breached the walls of Jerusalem on the 9th of Tammuz in the year 3338 from creation (423 BCE); King Ziddikiahu of Judah was captured and taken to Babylon (Jeremiah 39:5. A month later, the capture of Jerusalem was completed with the destruction of the Holy Temple and the exile of all but a small number of Jews to Babylon). Tammuz 9 was observed as a fast day until the second breaching of Jerusalem's walls (by the Romans) on the 17th of Tammuz, 3829 (69 CE), at which time the fast was moved to that date. (Talmud, Rosh Hashanah and Tur Orach Chaim 549)

O Mother Dear, Jerusalem...

Kennedy speaking for the dissenters:

10:28 Lyle: In opening his statement in dissent, Kennedy says: "In our view, the entire Act before us is invalid in its entirety."

I’m no lawyer, but how can the Court change it to a tax? Congress has to do that!

From a Drudge blurb from the opinion:

'Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it. '

So Roberts actually read the bill, and it drove him mad.

Kennedy got it right but Roberts got it wrong - even after his extremely skepical questioning during the hearings.

Does anybody now doubt what I’ve been saying for a long time now - that John Roberts has been threatened? The measure of the value of a hypothesis is if it accurately predicts future events. I had this one pegged - against the collective wisdom of Intrade. And even against folks with insider knowledge, like Jake Tapper who claimed that Roberts was going to support Obamacare in order to hold Kennedy’s hand. In the end, the whole thing stood or fell with Roberts, and he did exactly what Soros told him to do. Just as I feared and stated publicly based on my belief that Roberts has exhibited signs of being compromised all along, ever since the day of the Donofrio conference when Roberts made an unprecedented and unethical ex parte invitation to Obama to visit SCOTUS.

His vote on Arizona was not to buy Kennedy’s cooperation on Obamacare. His stances on both decisions are unconstitutional.

He’s the mouthpiece of George Soros - after Soros told Roberts he and his communist-Islamist alliance would make another run on the bank if Roberts didn’t do as he was told.

This country has literally been taken hostage. This is exactly why Obama’s ineligibility is so critical. Once the camel’s nose is under the tent, it’s just a matter of time before the whole thing comes down. They got Roberts to swear in Obama and ignore all the eligibility cases by threatening another run on the bank, and now they can use the same threat to do whatever they darn well please. At this point they don’t even care that people are figuring it out.

2008 was a communist-Islamist coup. Simple statement of fact.

First off I guess the SCJ can change the entire argument about funding this monstrocity?
I guess they are saying the SC can not stop Obama from taxing the people for this.

Otherwise, I don’t see this is a win for Obama. It only means he can tax the rich in order to pay for this. Good luck raising the taxes needed to fund this peice of crap.

All of this would not be quite as sickening if half the country who doesn’t pay the taxes that fund this would actually pay taxes? You know flat tax..blah blah blah.

It means you are not being forced to buy anything. Only that you have an option not to, but must pay a tax if you don’t.

The Republic has died and you were there to hear its last gasp. This is nothing more than an open invitation for unlimited governmental power.

It's a judicial travesty to rival Dredd Scott.

That’s pretty much it. We finally put some boundaries on the Commerce clause, but we’re still stuck with the damn law.

Actually I agree - the word “punted” was the first that came to mine. They found a way to kick the can back down someone else’s road.

I’m almost to the point of saying it’s a good thing the Supremes upheld Obamacare and struck down Arizona’s immigration law, it will hasten the coming financial and social collapse of the United States from decades to years. Then maybe we can “hit the reset” switch and get rid of every Judge and Politican that allowed it to happen.

So now, are they saying Congress must rewrite the individual mandate to a tax in order to make Obamacare a reality?

No, I believe that the Roberts' court just magically made it a tax. Voila!
