I think the Justices have telegraphed the results. Here's why.

True -- and then Obamacare morphs into a completely different monster. But Congress needs to fix that new "Law of Unintended Consequences" Obamacare-without-mandate before the entire health care industry (20% of GDP) collapses and becomes the next domestic automobile industry. Or they should fix it before it collapses.

I believe someone at SCOTUSblog today posted that Scalia and Ginsburg regularly read their dissents like that.

Part of me hopes that Thursday morning I’ll climb out of the shower and towel off, take a sip of coffee, turn on the TV and see Juan Williams pitching a fit on FOX because it has been COMPLETELY overturned.

BUT I just can’t shake this gut feeling and it’s killing me. Damn!

You are correct. Even if 0bamascare is stuck down, Hussein will implement it piece by piece through regulations. After all, he fancies himself as Emperor Hussein I of Amerika, after decreeing that he would only enforce those laws he liked, and having congress barely react.

1. Ginsberg's comment the other day about people who know aren't talking ...etc.

I watched that speech on CSPAN I was drawn to her remarks about how ideas put forth in two of her dissents had later resonated in the Lilly Ledbetter Act and in Jerry Brown commuting the prison sentence of a woman who's appeal for the shaken infant death of her grandchild had been denied by SCOTUS. My take was she was bucking up a very sympathetic following for the prospect of another dissent on her part with regards to the signature ruling of this court....ad I'm sticking to it...

If that's true, it gives me some hope. Ruth Buzzi was the one who seemed to want to lop off the mandate ("like a head of broccoli") and keep the rest. If she's dissenting, perhaps she didn't get her way.

I think I also read on the SCOTUS blog that Kennedy is co-writing the opinion with Roberts. He was th one question mark (Kennedy). Surely, siding with Roberts, with Ginsberg opposing, an overturn ruling is in order.
