Woman sentenced for lying about rape [Denmark]

Three men spent 14 months in jail before being acquitted due to the false testimony of an 18-year-old woman who will now receive psychiatric treatment

The woman’s testimony lead to three men, who where were 16, 17 and 18 at the time, spending 14 months in jail for rape.

But after the younger brother of one of the accused secretly recorded the girl admitting she lied about the rape, the three were retried, cleared and each given compensation of between 600,000 and 700,000 kroner.

In court yesterday, the woman was found guilty of having lied about the involvement of two of the men who she said held her down while the third man allegedly raped her in the handicapped toilet at Fredericia train station on 13 September 2008.

One of the three imprisoned men, Sharif Saloni, said he was disappointed that the girl did not receive a prison sentence.

“She ought to feel a little bit of what we felt when we were locked up,” Saloni said, according to Jyllands-Posten newspaper. “Nobody deserves to go through what we went through.”

Saloni also expressed disappointment that the court did not find the woman guilty of lying that he raped her, and instead found only that she lied about the two other men holding her down.

According to the prosecutor, it was not possible to find her guilty of lying about the rape, as it could not be proved that she did not think she was raped.

“We need to put ourselves inside the girls head,” prosecutor Birte Wirnfeldt told Jyllands-Posten. “What was she thinking when she testified against Sharif Saloni? We cannot disprove that she felt raped. But still, that is not the same as saying a rape took place.”

ANYBODY that bares false witness like that should serve a mandatory sentence the same as they tried to inflict on the innocent party...

Reading the headline, I thought I understood what transpired, until I read the article...now I'm not so sure.

Mixed feelings on this one. During those 14 months there were probably a handful of other women who were spared from these guys.

I'll have to go back and check, but this is about the most idiotic thing I've ever read. Just unbelievable the way some people think.

I'm with you on thisa one. Key sentence:

So she told the truth regarding one of them? More here than meets the eye. I say send Giovanni Henricksen over to have a chat with these boys.

So... what are we to conclude from this mish-mosh?

That she was, indeed, raped, but not held down?

That she fabricated the entire incident?

That an entirely consensual act took place?

It seems a vague article, IMO.

You never know with that bunch. Ideally they’ll just send them home...but getting them off the street is second best.

She's sentenced, she's not sentenced, she's raped, but maybe not, but maybe felt like she was...

Thou shalt not bear false witness against thy neighbour.
Seems pretty straightforward to me. Not much wiggle room there.

There is no real evidence against the two co-accused - apparently, they were not even present, much less holding anyone down. If the person accused had really raped her, one would expect to see better evidence. So, I do think this was an injustice.

Oh no, I think it an injustice that they were jailed. I am also doubtful that the accuser should be sentenced only to “psychological help” (what’s that?)

I was replying to some posters who seem to think that even with shaky evidence, these men should be put away. But that is just not right.

We know that the story which led to the original conviction was false. As to whether she was raped, it is one person’s word against anothers’. So we will never know for sure. Not enough grounds for a conviction.
